The first-instance court's judgment has been changed only in terms of the sentence of punishment, as of 3 years and 6 months in prison, the accused has been sentenced to 5 years.
According to this court's assessment, the circumstances outlined and assessed by the court in the first degree do not justify the pronunciation of the prison sentence in the course of three years and six months, as sufficient for achieving the purpose of the sentence, for criminal work in question, in which two F.R. people have lost their lives. 23-year-old and 30-year-old L.A., because it's not proportional to the intensity of the protected good, nor to the level of criminal responsibility accused of execution.
The accident took place last October, where a 30-year-old and 23-year-old lives were lost as a result of this accident.
