Court of Europe mars the comfort of the minister of tips that left 40 percent of farmers without subsidies

Pal Lekaj is recognised as one of the most problematic ministers in the government HINA Haradinaj.

Over the years, he has faced court processes under suspicion of corruption, abuse of duty and embezzlement.

Once an accusation fell, the other would rise.

It has now been more than a year and three months since Kosovo's Special Prosecutorship had filed an indictment against him.

He was accused of misusing official duty and embezzlement in office while he was head of the Gjakova municipality.

In addition to Lekaj, the accused were former director of the Agriculture Directorate in the Gjakova municipality, Ismet Isufi and five other officials.

The act against Lekat and others was for the 2008 period, 2014.

According to the prosecution, the accused, with the intent of illegally benefiting himself or the other person, have adopted the property entrusted to them according to their official position.

They had not properly supervised the distribution and payment regarding subsidies that were sharing municipalities for farmers.

Lekaj for the distribution of subsidies during that time, had engaged business “U n NION-VL” It was done without contract or agreement.

Thus, this business had left 40 percent of farmers without subsidies. And for that, neither Lekaj nor other officials responsible for distributing and paying these subsidies had reacted.

The prosecution claimed that Lekaj and his associates caused damage to the Gjakova municipality budget at the value of 69,786,00 euros.

Under the indictment, decisions issued by defendant Paul Lekaj covered only the amount of 235,400 euros, while other decisions that had no legal basis amounted to 631,671,82 euros.

The indictment said that as a consequence of action contrary to the Law on Public Finances, bills accepted by defendants do not include the content of concrete transactions because they have not respected the funding for subsidies, taking monetary means and other budgetary lines.

The Prosecution Act against Paul Lekat of his associates was thrown in part by the Constitutional Court in Gjakova.

This court had confirmed the indictment in terms of criminal activity “the misuse of official position or authority”, until it had rejected the indictment for criminal work “task approval”.

The court's then ruling said that in terms of misuse of office, to accused Paul Lekaj, evidence that has been attached to the indictment on the part of the prosecution is acceptable and their sustainability will be confirmed at the main review hearing.

The process against Paul Lekaj, now Minister of Infrastructure, is continuing today.

The Gjakova Foundation Court has confirmed that four court hearings concerning the case have been held so far.

“The initial review involving the plea about the plea, the second review involving opposition to evidence, and the request for the prosecution, as well as two key review hearings --”, is said to be in response to this court given to Periscopi.

Minister of close affection who had left farmers without subsidies

In his presentations, Lekaj can be distinguished as one of the ministers, perhaps the most generous of the government CHAharadinaj.

In some cases, he had given tips that were necessary in various organizations.

In October last year, when Lekaj had gone to Pec for the inauguration of the Zahaq Paj Street, he had given a tip of 50 euros to one of the musicians present at his reception.

How he was freed from his first act in times of choice

It was May 15th, 2017, when the Gjakova Constitutional Court had announced that it had stopped criminal proceedings against defendants Paul Lekaj, Qazim Mehmeti and Nikola Llesey, who were accused of misusing official duty in co-ordination.

The court's plea for the first indictment had taken place just a few days before political subjects handed over lists of candidates for MPs to the Central Election Commission for parliamentary elections, held on June 11, 2017.

According to the indictment, Lekaj, Mehmet and Llesey were charged with overcoming competencies in the month of March 2012 in order to benefit any wealth for themselves or for the other by causing damage to the Gjakova municipality and residents of the village of Jahoc of this municipality in a road asphalt project during the time that Lekaj was head of the Gjakova municipality.

The court's prosecution was made in the absence of evidence.

This demonstrated once again the level of efficiency of the courts, in cases when powerful indictees are rushed to complete the court processes involved.

Meanwhile, which has become more than a year and the second judicial process towards Lekaj has not yet been carried out.

Who knows? Perhaps this will happen in September this year, when early elections and the fall of Haradinaj Government are alleged.
