Case “Stanta”: Agan denies that he favored privates

In Monday's review, management of proposed evidence with the prosecution's indictment was conducted, and several proposals were also made for new defence evidence in the case of Agan and Saban being accused of misuse of office.
In the midst of evidence proposed by the defence, accused Ferid Agani proposed that three memorandums of co-operation be taken as evidence, as he said, for the development of public services at the University Clinical Centre of Kosovo (QKUK), invasive cardiology and cardiogenic.
Agani as evidence proposed a memorandum of co-operation with the Italian government for the “project supporting the health system in Kosovo, with the focus of invansive surgery and cardiosurgeon services”, as well as a memorandum on providing soft credit from the Austrian government in value of 4,25000 euros for the purchase of the necessary device for these two services and a memorandum with Tirana's University Hospital Centre for providing 24 hours of cardiology services for invas and cardioturism.
These proposed to bring down the prosecution's claim that during my term I was only focused on providing financial benefits for two private hospitals ( EDA and IMH) not for the development of invasive cardiology and cardiology services, because I have been committed since the first days of my mandate to develop public cardiosurgeology and cardiology, and for that purpose I have even established a special professional organ, the state board for the development of the services mentioned above”, Agani said.
Otherwise, his defender, lawyer Adem Vokshi, said that as new evidence in the trial, seven more agreements to provide services outside public hospitals, in addition to two deals with private hospitals for which the prosecution has offered as evidence.
Vokshi also proposed that an auditing report for 2014, 2015, and 2016 be taken as evidence, for according to him, the audience advises the MS on linking the contracts to recovery of patients outside public institutions.
The defender of accused Gani Shaban, lawyer Nike Shala, proposed to the court that several young witnesses be invited to testify, proposing that, as a witness, Najazi Gashi, former director of KKUK, be invited to the tribunal as a key person and responsible for serving drugs and saving materials at QKUK.
Shala also proposed that Isa Latifaj, former director-general of the MSH audit, and Ismet Hyseni, be invited as a witness, in quality of the director of the Procurement Department, in the MSH. Lawyer Shala also proposed that Besim Mulaj, as court expert, be invited to quality procurement expert in order to distinguish between spending public money and subsidies.
Shala proposed that official reports involving wiretapping of the two Saban numbers and in which reports according to Shala have concluded that no communication has been found concerning his defense.
He also proposed several e-mails that Shala has sent and accepted, during how long the accused Shaban was a task attorney and secretary general in the MSH.
The chairman of the court, Judge Shadije Grguri, asked the defenders of the accused to bring all proposed evidence into physical copies at the next session so that the prosecution's position can be taken and related.
Otherwise, defenders of the accused, after reading the proposed evidence in the indictment, asked prosecutor Florije Shamlli to be identified as evidence only those dealing with their defenders, for according to them, there is a large number of indictees in the case.
Prosecutor Shamlli stressed that I will do this only in the final address, as the accused will grant their protection.
Former Prime Minister Agani and former Secretary Shaban, who by the Special Prosecutor of the Republic of Kosovo are accused of misusing the official position, had been declared innocent about the charges they are charged with in the initial review held on February 26th of this year.
In the initial review of February 26th, it was also announced by the judge of this case, Shadije Grguri, that accused Agani and Shaban will continue to be tried separately by other indictees, who will be tried in two other procedures.
The State Prosecutor, on June 15, 2016, had filed charges against former Health Minister Ferid Agani, MS Secretary General Gani Shaban and 62 other people for criminal acts “the abuse of official position or authority”, “bribe taking”, “bribery”, <6> irresponsible medical treatment”, “The legalisation against legal activity and pharmaceutical activity <x> and <106>
Meanwhile, the prosecution had resigned from prosecution against cardiologist Africa Bekteshi, arguing that the same was wrongly involved in the indictment.
In this criminal case, investigations were initially conducted against 116 physical persons and 4 legal persons. However, for 56 physical persons, no legal conditions have been met to be included in this indictment, so the same investigations have ceased. / Justice Trust
