The Ministry of Integration with task guides in three leadership positions

According to the ZKA's findings, in terms of keeping office positions, three leadership positions are said to be handled by task leaders in this ministry.

“We have noted that in MIE three leadership positions are maintained by task, exceeding the limit allowed for holding such a position. One of these positions is held with the UD since 2015, until the other two from May 2017, because officials who held these two positions were on leave free of charge, with the aim of professional advancement”, the ZKA report said.

Maintaining long-term task leader positions, according to the ZKA report, is contrary to applicable laws and can affect the quality of operational performance of the entity.

The National Audition Office recommends that the minister should ensure that all leading positions are exercised in regular labour contracts, which should precede the public competition conducted in accordance with the rules in force.

Also, ZKA has recorded a signature of the contract not in accordance with the tender file requirements.

“The contract signed for “Inventoral planning for MIE's needs”, worth 7,025 euros, according to the tender file request, envisioned the supply of 14 articles. All procedures, as well as the assessment of financial offers, have been made in proportion to these requirements. But the contract signed with the winning economic operator had specified that the ministry will be supplied with only six articles from the list of offered articles. This is contrary to requirements that are presented by entity in the tender file, as well as the requirements of the Operational Guide for Public Procurement A01 (Nini 47.40). Furthermore, if demand had been made only for the items that have been contracted, the winning OE's bid turns out to be up to 320m higher than the second bid”, the ZKA report said.

ZKA recommends that the minister should ensure that more detailed analysis of the requests submitted by the research units and only approved for rational demands should be made on the case of the reporting of supplies. It is also recommended that contracts be signed according to pre-represented demands in the tender file.

The report also speaks of the failure to complete the annual auditing plan, which states that the Internal Audition Unit (NJAB) for 2017 had planned to carry out four audits and an audit at request from the management.

This plan had completed three, regular audits failing to fulfill the plan. Until there was any request from the management for any audit”, the report says.

While, in terms of implementing recommendations from the previous year and year, the report says that despite the progress achieved, more remains to be worked on addressing them overall, in order to avoid repeated issues over the years.

Our audit report for MIE's PFVs, 2016, had resulted in six recommendations. MIE had prepared a Plan of Action showing the way I would apply the recommendations provided. By the end of our audit for 2017, four recommendations were implemented, one was under way, and one had not yet been addressed. And by 2015, three recommendations (incompatible). Two of these recommendations in 2017 have been implemented overall while a recommendation was not implemented”, the report said.

However, the report says the Ministry of European Integration generally has good controls in relation to its legal obligations.
