Court rulings by the Judicial Council continue to be ignored

Ignoring the court's decisions by institutions in the Republic of Kosovo has not been a rare thing, however, a situation where the Kosovo Judiciary Council, the body responsible for the functioning of the judiciary, is silent and comment on a request stemming from a court decision, has not occurred before.
At the meeting held on May 30th, some of the KDR members have rejected providing access to BIRN in disciplinary decisions, those for which the court has already decided to be public.

Although at the point of the agenda, some KDK members gave themselves freedom to comment on and oppose the almighty judicial decision with which the Kosovo Prosecutorial Council was obliged to provide access to BIRN in final disciplinary decisions, thus creating an unprecedented case in the country's justice system.

The Balkan Investigative Journalism Network (BIRN) in 2012, had demanded from the KKP, access to final disciplinary decisions while this request was rejected by the KKP. After that, B The IERN was addressed to the Pristina Foundation Court, which had decided in favour of BIRN. The decision was shaped after the Court of Appeals had decided on it.

On the basis of this decision, B IRN in November last year had called for the analog implementation of this decision by KRK as well and thus to be given access to BIRN in final disciplinary decisions.

BIRN had not accepted answers until once again this year's May 5th request was re-sented to the KJK, and as a result, had accepted answers that BIRN's request for access to final disciplinary decisions would be addressed on May 30th at the Council meeting.

Initially, the first to oppose the tribunal's implementation of the verdict was KDP member Armend Berisha, who initiated his contest with an action that can be seen in the video and wants no comment.

“The Court of Appeals' decision casts the KKP's complaint as inconsistent and does not issue on merit cases and I have seen those decisions. From the experience of Judge Manushe's visit to Italy and we have consulted a colleague from France, they were not giving the names of judges. They release them since we publish them to us, anonymously”, Berisha said.

Berisha went on to express his opposition this time through a personal opinion.

My personal lesson is this: let anyone think about what he wants, but in that minute that we publish our name and name and last name he doesn't know how to judge. It's a bit of a problem. Now we are here to take the cover and the attitudes and decisions that are very popular but that are right”, Berisha said.

In contrast, Berisha, the BIRN's request based on the Court's decision was rejected by members Mkaifete Saliuca and Manushe Karaqi.

Seeing these objections, the issue was not put to the vote at all, but it was decided that “is enabled”, even further and KDP members were given the decisions of Foundation and Appeal on the matter.
