Kosovo's Afarism Oda has been addressed today with a letter to the president of the Republic of Kosovo, Hashim Thaci, who, based on the competencies given to the Constitution, will once again return the law on commercial societies to Kosovo in order to eliminate Article 34 points 2 or to be reformed according to the democratic principles of a free and competitive economy, in full co-ordination with the business community.
You can find the full letter below:
To: SHLT Hashim T HACI
President of the Republic of Kosovo
From: Kosovo's Afarism Oda
Subject: Request for non-deception and return to “Laws for commercial societies”, respectively, Article 34.
Mr. President Thaci,
The business community, represented by the Kosovo Afarism Oda, is extremely concerned with the adoption of the Law for Commercial Societys, respectively, Article 34, provisions 2 of this law, which obliges private businesses to have 40 women on their boards and after the two years 50 %.
This article with this statement, except that it is directly intervention in business autonomy to run its business, is also contrary to Kosovo's constitutional spirit. (City of the Republic of Kosovo, Chapter 1, Article 10. The free competition market economy is the basis of the Republic of Kosovo's economic adjustment. )
Your Honor. President
Intervention in business autonomy through laws aimed at <x0-> raising the number of women in decision-making” does not help create new jobs and, above all, create barriers to potential world investors.
The Kosovo government finally after 10 years of independence has operated the law on strategic investment to enable the arrival of foreign investments. With the entry into force of this amendment, which does not exist in any country in Europe, Kosovo is virtually blocking the arrival of multimillion investment by directly interfering with the way company management is managing.
In view of these, the Kosovo Afarism Oda requires you, the honoured President, that under the competencies given to the Constitution, to bring the law back to the Kosovo Assembly once again in order to eliminate Article 34 points 2 or to be reformed according to the democratic principles of a free and competitive economy, we co-ordinated fully with the business community.
Kosovo's Afarism Oda is in favour of any initiative that would help increase the number of women in business and decision-making, but requires these initiatives to be discussed in advance with business, as well as to be in line with the principles of a free market and a competitive economy.
The free market is built on the basis of fair competition and meritocracy in corporate employment and governance.
Pristina, 17.03.2018
Respectfully
ODA AFARIZM COSOVA
