Chief Special Prosecutor Reshat Milaku has commented on the case of deportation of six Turkish citizens from Kosovo.
Millaku has said they were unaware of the act of arrest and then of their deportation.
We haven't had any information on the action. If AKI or anyone else had information that was threatening national security, then the prosecution had to be announced to conduct investigations”, Millaku said in a response given to “Koha Ditore”.
On the other hand, he has said the Ministry of Justice has submitted several requests to the Special Prosecutor for the extradition of a Turkish citizen whose name lies on the group's list of deportations.
“are several requests that have repeatedly come through the MD for the extradition of several Turkish citizens. But in these requirements there has been the sole name of one of the sixth group of deportees”, Millaku has further stressed.
The country's president, Hashim Thaci, in a proposal to the media during today concerning the recent case with Turkish citizens, has said that based on information he has obtained from AKI, six Turks deported by Kosovo have been dangerous to the country's national security.
However, according to the Law on AKI, this institution is obliged to inform the Prosecutor of such cases, whether when national security is threatened.
The Law on AKI, Article 25, among other things, says:
“25.2 Whether in performing its functions, AKI is convinced that there is a basis for doubt that a person or subject has committed or is performing a criminal offence, or is preparing or organising a criminal act that is subject to public prosecution, it is obliged to announce the general director of the Kosovo Police and the competent public prosecutor.
25.3 If a case stemming from Article 25.2 higher includes suspicion of a criminal offence against the security of the Government of Kosovo and its constitutional order, the director of AKI can submit a competent public prosecutor to temporarily suspend the execution of acts and measures in pre-penal proceedings when this is in the interest of national security, and when lives and the health of third persons with this are not put to risk by”.
