A month without signing the contract for the construction of the Morine-Merdara highway between the Government of Kosovo and the company “Bechtel-Enka”, Pristina Foundation Court has approved the application-suit of Movement “FOL”, with what is tasked by the Ministry of Infrastructure, that the FOL allows access to required documents.
Demolli-Niman, by ) FOLU, he said they have welcomed the act and expect the ministry to respect the decision.
“Based on the Constitutional Court Act in Pristina, this court obliges the Ministry of Infrastructure to allow us access to the tender file and the contract to build the Morine-Merdare highway. We also expect a ministry's readiness to allow us the required approach of eight years --”.
Demolli-Niman told Radio Kosovo why without recall they have sought access to the tender file and to the Morine-Merdare Highway construction contract.
“in 2010, there was no political will for this contract to be made public, and since this did not happen in citizens and civil society, suspicions of possible misuse over this tendering process and the whole contract have increased. ”
Since 21 April 2010, when contracts for construction of the Morine-Merdara Highway have been signed, Kosovars have been unable to know what this contract contains and how much its construction has cost. The project is initially said to be worth 700m euros, but was later said to have exceeded that amount.
Radio Kosovo has called for answers from the Ministry of Infrastructure about whether they will respect the court's decision and make public the documents required by the Movement huholı, but the response has been missing.
Access to public documents, even though it is legal, often denied Kosovars. And for that, in the ombudsman Institute last year, in 25 cases, help has been sought to realise this right, as access to the required documents has not been allowed.
