But none of them were convicted, as the Criminal Code of the Republic of Kosovo predicts

Pristina's Constitutional Court pronounced three people guilty, but it pronounced them only fine sentences. The relief of the sentence came after they admitted guilt and repented deeply of the deeds they were loaded with.

It is a case on April 3, 2013, that the judicial epilogue won only at the end of 2017.

The first rate has convicted three people of various criminal acts. One of them is convicted of using a weapon or a dangerous means, while the other two are being hired for assisting perpetrators after committing criminal acts. The three people, from the start of the trial to the conclusion, pleaded guilty and, says the court, deeply regretted the case, writes the newspaper Express.

In the village of Zabel of the Ult of the Glogoci municipality, right in the store “G...”, convict B. M, after a statement about a debt with the damaged N. R, it's addressed to the victim with the words: “You owe me and you're bringing me peace!

At that point, as the Pristina Foundation Act explains, the convict has already pulled the type “gun out of his belt. TT”, loaded with five bullets and pointed at N. R.

According to evidence given in court, the convict reportedly aimed at threatening and intimidation, telling “to kill as the dog”. Then, B. M, he left the shop and the gun he held in his hand gave to the third person, also sentenced by the court, with the initial E.M.

The reason he didn't hold his gun and gave it to someone else was to hide it. However, this weapon has been found by the police and confiscated.

Other defendants, E.M. and N. M, they were sentenced by the court for helping the perpetrators, B. M, hiding the weapon he committed, a threat to N.R.

After the initial person B. M, he handed over his gun to E. M.E., this guy sent the gun to the N.M. room to hide it. All three convicts belong to the same family.

The last two were charged and sentenced for criminal offence “providing assistance after conducting criminal acts”. However, the Pristina Constitutional Court has decided that these three persons will be pronounced only fine sentences, even though they do not foresee the Criminal Code of the Republic of Kosovo for criminal acts for which these three persons are charged.

The B.M. is sentenced to a unique fine sentence in the amount of 1,000 and 700 euros, E.M. and N.M. with 500 euros in punishment.

However, from the Criminal Code of the Republic of Kosovo, Article 375 “respectively, the use of weapons or dangerous tool”, the second paragraph, says that “anyone who uses weapons or dangerous means in a threatening or frightening manner is sentenced to fines of up to ten thousand euros and sentenced to 1 year to 10 years. The court has convicted him B. According to this article, he has not pronounced the extent of the sentence as he did in the Penal Code for this criminal act.

The same organ of justice has acted with two other convicts, E.M. and N.M. In the Penal Code of the Republic of Kosovo, Article 388 “assisting officials after carrying out criminal work”, paragraph 2, 2.9, say that “if the criminal act from paragraph 1. This article has to do with one or more of the ongoing criminal acts, the chief is sentenced to prison for six to five years for weapons criminal acts.

The state prosecutor for the case, reportedly in the indictment, has agreed to the guilty's plea. In the meantime, the Court approved the plea, for it became convinced that the accused understood the nature and consequences of admitting guilt.

Thus, the Court takes into account that admission of guilt has been reached in the initial examination, has acted in line with Article 248 par.4 of the KKPPRK, when the chairman of the court can continue the procedure with the pronunciation of the sentence without even going into court examination and without completing the court.
