For several months the Special Court has been functional, however, no charges have been filed.
The lawyer, Tome Gashi, has said that the start of the Special Court's work has nothing to do with forming the New Government of Kosovo.
The Special Court in The Hague has long been functional and completed the legal system, so it is actually operational and has been functional for months. However, it is no longer up to the Special Court for the opening of the first judgments because it is functional, but it is from the specialised prosecutor's chamber, which the prosecution operating in The Hague but is a completely separate institution by the Court and the prosecution must hand over the first charges for the Special Court to start working and judge the cases that will be submitted”, Gashi has said.
And he adds that no one has accurate information about when the first charges start, as, according to him, the prosecution has closed the investigation.
When the Special Court begins to be effective no one knows exactly, it depends entirely on the prosecutor's office. It depends on them when the first charges are sent. I think it's prolonged the Special Court's non-functionality and this is completely in the hands of the prosecutor. And anyone who says otherwise can only speculate because no one has accurate information because the prosecution has closed the investigation and it will determine when to submit the pre-” charges, he added.
Otherwise, Kosovo has fulfilled all obligations on the functioning of this court.
