Peja's Constitutional Court, with the ruling of July 25th of this year, had rejected the indictment against former Gjilan leader Kemal Mustafa, who is accused of organised crime over abuse of official office.

The Court of Appeals next shows even more rigid with the Peja Court, arguing that the latter has violated even a judicial principle.

For organised crime related to the abuse work in the economy, accused in this case are Basri Kqiku, Avdi Piraeus, Rrustem Hajdari, Florim Zuka, Skender Imer, Naser Mehmeti, Maydi Ahmeti, Burim Govori, Aslan, and Aslan Syla.

According to the indictment, officials acting on the quality of official persons have misused official duty by overcoming their competencies, or by failing to fulfill official duties, while other defendants acting as owners or representatives of these economic operators have exercised economic activities with the aim of illegally benefiting property for themselves or for the other economic operator, with the case of bidding on procurement activities in the Gjilan municipality.
Always in accordance with the indictment, former Mayor Qajajl Mustafa has co-ordinated this group's activity about setting up procurement activities, determining the winner of the tender, always agreeing in advance with the defendants now, more precisely the owners or representatives of economic operators (businesss) mentioned in the indictment.
