University professor Mazlum Baraliu has clarified about the "%Indexoniline” that the largest parliamentary group, in this coalition case. PDK-AAK-Nisma can present his candidate whenever he wishes, since that is what the Constitutional Court ruling says.
It is this point that makes Albin Kurt's proposal stalled.
The “may have problems in this proposal because in Article 67 paragraph 2 of the Constitution, which says only the largest parliamentary group in this case even the pre-election coalition has the right to propose and the proposal is valid not only for once but more, until all possible MPs vote. Second, the 2014 Constitutional Court ruling goes even further in favour of this coalition, which only they can propose. So in both directions it's credulous anybody's proposal to get the primatitis and take the initiative for voting proposal outside the coalition. PAN for head of the Assembly”, Baraliu said.
Baraliu has commented on President Hashim Thaci's role in this regard, saying he has no influence on this constitutional issue. According to Baraliu, any influence of his would be intervention in the Constitution.
The president has no influence because it would be his intervention in the Constitution and the interpretation of the Constitution. The president has a authorisation to influence the constitutional functioning of the country's institutions, paragraph 1 for maintaining unity, but cannot interfere more with Article 67's provisions, as far as the proposal is concerned, he has stated.
Baraliu has added that the Constitutional Court, with the 2014 ruling, has left open the possibility that the same candidate of that same parliamentary group could be proposed until the right is offset. This, according to him, has created a president who will face the country in years to come.
