Arben Frrock is not giving up. Two months after the Supreme Court repaid its sentence for life, 49-year-old was addressed to another court, allegedly violating constitutional rights.
A source told Top Channel that, through lawyers in Albania, Frock has handed over an indictment to the Constitutional Court, in which he seeks retrial.
Insisting the life sentence of the Court of Appeals for the Criminals, the Supreme Court did not accept Arben Frrock's recurage, and that is why the sentence has been due for the defense to take a look at the Constitution.
A source close to this court confirmed that, lawyers argue, as violations of the fact that the same judges who gave the life sentence, in fact, have previously examined the measure of personal security.
In this situation, according to lawyers, the trial has been prejudged and the Supreme Court's decision must be broken and retriald.
In the meantime, Arben Frockk is held by Dutch justice until he has a decision whether he will be extradited. Frock was declared in search of the murder of former head of the Komiserate of the Nation, Dritan Lamaj, who was shot in a hailstorm in February 2013 as he returned home.
During the trial, the First Level acquitted him, while with the same evidence, the Second Stairs Court (Apel) established life in prison. But the First Stairway decision, which granted him freedom, also gave him time to escape from Albania, even though months later he was arrested in the Netherlands under a false identity and with documents from a Greek national named Renato Tsepa.
