Frasher Krasniqi's speech, lawyer: MP has immunity, no criminal responsibility for statements

But contacted by Indesksonline, lawyer Arian Koci has ruled that it is the right and primary duty of each MP to have a political position on each situation, in this case Krasniqi's.
The political stances in the Assembly are artified between both votes and speeches. Not by chance the MP immunity institute is embedded in the Kosovo Constitution. This means that they do not bear criminal responsibility, nor do they have civil opinion on their post as MP”, Koci has said.
According to him, the issue of criminal procedure that is under way against MP Krasniqi has nothing to do with being MP, nor with speeches it holds.
The “would be a judicial paradox of its kind if the Court were to intervene in the political positions of MPs and therefore penalise them in any form. The Kosovo Assembly is the site of debate and the promotion of any debate is welcome”, Koci has added.
I personally think Haradinaj is a living hero and no debate can change that conviction. As for Krasniqi, it is not at all the authority of the Court to assess MPs' speeches, and that in the concrete case such speech or even promoting any debate should not be taken into account in the Court's assessment of allowing MPs to participate in the session or not”, Koci has concluded.
