Article 102 of the Law for Automedia indicates that mobile technical control is carried out by the Ministry of Infrastructure, or any subject authorized by this minister, but to carry out this type of technical control requires the law to be met with a sublegal act in which conditions and criteria should be determined that must meet the subject for technical mobile control, Telegrafi writes.
But to carry out mobile technical control, the technical control centers must first be controlled by relevant devices that have a cost to them. Article 103 of the Automedia Law tells of the method of implementing technical mobile control.
“1. Technical mobile controls on the road are subject to tools that manage to develop speeds of over 25km/h.
1.1. Designed and construction vehicles mainly for the transport of persons and suitcases, M1, M2 and M3 categories;
1.2. Designed and construction vehicles for the transport of goods the N1, N2 and N3 tools category;
1.3. The trailer designed and built for transport of goods or persons, as well as for access to persons who have maximum size exceeding 3.5, auto categories O3 and O4;
1.4. T5 category wheel tractors, which are mainly developed on public roads for commercial road transport purposes, where the most projected speed exceeds 40 km/h.2. Selecting means for technical control should be done by chance and without discrimination. These rules include Article 104 for the inspection of vehicles on the street.“1. Selecting the vehicle for control of technical orderliness on the road as well as during the search, authorised officials and inspectors must refrain from any discrimination.2. Compensation for engagement of the mobile unit is not directly linked to initial or detailed results of the vehicle technical regulation control.3. Advanced inspections of technical regularity on the road must be conducted by inspectors who meet the minimum requirements of competence and training assigned by the Ministry”, points out Article 104 of the Automedia Law.
