After the chairman's resignation, the municipality must go to the polls with a decision by the president of state. But since local elections are announced to be held very quickly, there is uncertainty as to what exactly will happen”, he said.
After the recent parliamentary elections, the MP's mandate has won the head of the Gjakova municipality, Mimoza Kusari-Lila (from the LDK-AKR-Alternativea coalition), Pristina chairman Shpend Ahmeti (from VVV), and Decani's Rasim Selmanaj (from coalition) PDK-AAK-NISMA. Kusari-Lila and Selmanaj have resigned, Ahmeti still.
The Law on Local Self - Rule states that at the request of the chairman, the deputy head helps the chairman to exercise day-to-day executive functions and acts on behalf of the mayor in his absence. Mucaj says that in the event of the resignations of the mayors of Gjakova and Decani, the municipality's deputy chairman could accomplish some work. But the mandate of the city's first one is not carried to him because the mayor is elected directly by citizens and vice-presidents by the mayor himself.
Also, according to the Law on Local Self - Rule, mayors cannot hold two positions since this presents conflict of interest. On the other hand, the Law on Local Elections in Kosovo stipulates that at the early end of the mandate, new elections are announced for the new chairman whose mandate ends with the same date as the president's mandate he/she replaces.
So if early elections in Gjakova and Decani are announced, the mandate of the new mayors will last until October 22nd 2017, which is the date of holding local elections at the level of Kosovo.
Today's circumstances -- when local and parliamentary elections are held within a year -- and three mayors can't easily be identified with existing laws. But, since we are in this year's summer holiday season and campaigning for this year's local elections will begin on September 21st and last until October 20th, it remains that Gjakova and Decani until the election of new mayors will operate with deputy speakers.
