Special Court Empowering, Hurdled Procedure

Mazlum Baraliu, professor of Constitutional Law, speaking of Radio Free Europe, explains that in principle, the Government of Kosovo can make the draft law on the abolition of the Special Court and send it to the Assembly.

According to him, the Parliament would then have to call the Priory again to set up the session agenda and then, by majority, send this bill to the parliamentary hearing.

But according to Professor Baraliu, the first obstacle to further proceedings on such an evental bill could be encountered at the Assembly Chief.

Efforts that were made on Friday in the Kosovo Assembly by the three ruling parties -- the Democratic Party of Kosovo, the Alliance for the Future of Kosovo and the Kosovo Initiative regarding the proposal to abolish the Special Court -- have sparked the harsh response of ambassadors of Western countries in Kosovo, but also civil society.

Imer Mushkolaj, connoisseur of political developments in the country, tells Radio Free Europe that it takes into account the mood with which leaders of Kosovo's high institutions have approached the Special Court in recent months, is not surprising their action on Friday.

I believe that all of this has nothing to do with, but only personal interests, first of all, the president of the country, who wants in this form to prove to pressure, to escape any possible indictment that might be directed against him”, Muskolaj estimates.

According to him, a eventual decision by the Kosovo Assembly to abolish the Special Court would bear serious consequences for the country.

I believe the consequences will be too big and I wouldn't be surprised to absolutely give up on us and then the situation, in fact, turn around. Because I fully agree with the U.S. ambassador's statement (Delai) that this is a knife in the back, not only for international friends, but, first of all, is the stab behind the back of Kosovo's own state”, said Mushkolaj.

The Kosovo Assembly on August 3, 2015, had adopted with accelerated procedure the Law for the Special Court. The approval was made by majority of votes, but without the participation of opposition parties, which at the time boycotted the Parliament's work.
