The Court of Appeals has turned into retrial and re-establishment of the criminal case against Kosovo Agency for Products and Medical Equipment officials who are accused of being released banners for company medicines “Prima Pharm”.
The prosecution of the Appeals Court's decision states that the device's act along with the punitive part issued by the basic court is unclear and unintelligible.
The Court of Appeals finds that the reasons presented in this court are contradictory in terms of crucial facts, so the first degree trial is involved in substantial violations of criminal procedure provisions.
According to this act, it is said that the first - degree court must avoid the above - mentioned offenses, so the criminal case is annulled, and the same turns into retrial and restoration.
Ilir Dusin's basic court had sentenced him to six months in prison, while Haki Ejupi had pronounced him a five-month prison sentence.
And Edon Hajrlawa had fined him 10,000 euros.
Bersan Kolgeci, Ilir Dusi and Haki Ejupi from the prosecution are charged with being official in the AKPPM, releasing 435.124 drug banners for the company “Pharma Pharm”, whose director is the other indictee Edon Hajrllaga.
Kolgeci, Dushi and Ejupi are accused of abuse of office, while Edon Hajrluga is accused of forbidden production.
According to the prosecution, Bessan Kolgeci, who was director of the Legal Department at the Medical Products Agency, had recommended to the director of the administration of this agency to release banners for 18 medical products company “Prima Pharm”, enabling it to market drugs imported from China on 23 March 2013.
The prosecution claims Kolgeci had not had to issue such a recommendation for the reason that the company “Pharm” was not certified with PMP-Good Production Practice.
