The defender of former MTPT minister, lawyer Tahir Rrecaj, has told “Arbre.info” that it is expected that the Constitutional Court's decision will become overwhelming and then, according to him, an indictment for compensation will be made, or the existing indictment that has been filed in the case of “Klicka”, which has been handed over to the court for compensation.
We have to wait, because this is only a first-instance decision, the prosecution has the right to complain, if it complains, should wait for the Court of Appeals' decision, if it doesn't complain within 15 days, the judgment is made by a definite form and we can make a new indictment, or expand the existing” indictment, Rrecaj has indicated.
He says he finds it more reasonable to expand the indictment's request for compensation for material damage and not material even in the MTP case, if the act of this case becomes all-powerful before the court decides to apply for the lawsuit in the case “Klicka”.
The justice system, according to the lawyer, should be conscious once and for all, not to charge and judge people without evidence and bandages.
“Limaj has not yet mentioned this indictment, but we will certainly seek, since prosecutors and courts must be disciplined and conscious not to file charges without any evidence, as has been the case of MTP, but also the court that has authority to assess in its early stages that there is no evidence”, Rhecaj says.
He says to establish the amount of compensation that will be required as compensation, the defence will make a request and will engage experts who will assess the moral damage Limaj has done for the past eight years.
Limaj, in this trial, was charged by the Special Prosecutor of the Republic of Kosovo for organised crime, while minister of the Ministry of Transport was in 2008.
Along with Limaj, the Telaku Rescue, Andrew Shala, Nexhat Krasniqi and Florim Zuka were also charged.
Otherwise, close to 7m euros is the amount that former commander “Celiku” Fatmir Limaj has demanded compensation from the state for the unjust judicial process against him in the “Klica” case.
His three-time trial against justice in the case of “Klica”, in which the case was charged with war crimes during 1999 and the confirmation of innocence, has prompted Limaj to seek compensation for damage from the Kosovo Judiciary Council, amounting to 6 million and 987 thousand and 314 euros.
This indictment came after Limaj has rejected the Kosovo Judiciary Council's offer (KGJK) for retaliatory the case known as the “Klicka”.
Limaj's refusal of the offer has come, as the amount provided by the KDR did not reach even 1 per cent of the 7 million it had demanded.
The Commission's offer for Compensation of the KDR damage was worth about 7 thousand and 305 euros, which was named as a symbolic offer by Limaj.
