The defendant from the municipality of Gjilan allegedly on October 27, 2017, had deprived her baby of life during birth or after birth and tried to hide the performance of this work.
With these actions the defendant allegedly committed the criminal act of killing the baby during birth.
Under this act, the defendant will implement the detention measure after the health situation improves, since the same is hospitalised. She still needs to be treated at the hospital, given her immediate condition.
To improve its situation, it becomes known that the court will be announced by special reports by gynecologists at the Regional Hospital in Gjilan.
During the hearing, the case prosecutor, Leonora Shemsiu-Cadriou, has remained close to calling for the detention measure for the defendant.
According to prosecutor Shemsiu-Cadriu, there is suspicion that the defendant committed the criminal act he is suspected of.
The murder of her baby during birth, according to the prosecutor's words at the hearing, will be proven through criminal malpractice, request for autopsys, as well as the country's examination report.
The prosecutor in her request for a month-long detention assignment has stressed that if left in complete freedom, there is a danger that the defendant will influence her family, as well as the witnesses she lives with.
“Also, the legal condition has been met, because the nature of this criminal act is serious -- privileged murder, consisting of the child's deprivation of life, on the part of its mother immediately after birth, until the disorders caused by birth, the motives, the social risk of this work, as well as the way and circumstances in which this work has been carried out, her insistence on carrying out the criminal act”, has been cited in the court's act.
The prosecution has assessed that all other measures for ensuring the defendant's presence, but has come to the conclusion that none of the initial measures other than detention offer good conditions for normal development and the more successful criminal procedure.
At the hearing for the presentation of the detention measure, the defendant's lawyer, Lumje Azemi, has rejected the prosecution's request for the detention of her defender, arguing that given the birth-related disorders, as well as the defendant's deteriorating health situation, she has not been concentrated on giving statements.
Lawyer Azem has demanded that house arrest measures be appointed against her.
The defendant himself has supported this request.
