The ombudsman, Hilmi Jashari, has indicated that official investigations have been opened in the case of the electricity billing which Kosovo citizens have not spent.
“During the investigation we have requested answers from the Regulatory Office and the Ministry of Economic Development if citizens pay uninitiated energy that is spent in the country's north. We've received from the Regulatory Office an answer that says this is happening, so unexplored energy”, Jashar explained.
He has said in KTV that all this electricity billing is done under the pretext of commercial losses or electricity theft.
That's what we were told during a meeting of energy regulator officials, but I told you this isn't electricity theft, so it's not commercial losses, but it's an expense that's getting lucky to someone who doesn't spend it”, Jashar said further.
In his view, that decision is unfair.
“The law on consumer rights, the law on energy, the law on protection from discrimination and the law on binding relations that prohibits the groundless enrichment of individuals or legal persons or companies in legal situations, from consulting these four laws that we mentioned to them, turns out that this decision to bill electricity to citizens who have not spent it is an unfair illegal decision, so there is no support for even enough legal base of”.
“We requested what is the financial balance of KEDS company, this company has submitted a financial report drafted by the company itself, and the entire circulation is about 100m euros and half was profit.
The regulator's office has not responded to our recommendations to reverse this decision, then we sent the subject to the basic court and this decision has been stopped by the court and to wait for what will be done later”, Jashar said.
According to the Regulatory Office, 4.5% of the total is the value of bills at the level that citizens pay without spending at all.
I think there's room, that there are elements for criminal work, and the prosecution can start investigating how it came up here, so here's having baseless enrichment without a sufficient legal basis”, Jashar said.
