Milaim Zeka usurped residence during wartime, the court forced him to release the rightful owner (Document)

On December 4th 2001, then the Communist Court in Pristina had issued a plea against the then journalist, now Kosovo Parliament MP Milaim Zeka, to free a settlement in Pristina, for which Zeka had no evidence that it is his.

Milaim Zeka was placed in this apartment in 2000, under the pretext that he had paid for the residence a sum of 30,000 German brands, but there was no evidence of having no business contracts and of the person who had said he had paid this money had denied it, saying he had made no deal with Zeka.

According to the 2001 trial, Zeka had been forced to free the apartment of 66.35 m2, located on “Mother Teresa”, in the 15-day term and to hand over the real owner, Adam Wessel, who had filed a lawsuit against Zeka for usurping the apartment.

The indictee Milaim Zeka is tasked by Pristina for the plaintiffs to be freed from people and items and hand over to the apartment that is located in Pristina, reg. Mother Teresa”, No. 24.

Adem Veselin had testified before the court that the apartment seeking to be released from Milaim Zeka had been purchased on August 30th 1999 by Stefanovic Petar, while the transaction had confirmed in court on June 12, 2000.

Wessel had declared before the court that at the time of the house-based trading, it was Enver Deliu from the village of Rhesall, the Skowright municipality, as homeless, while Milaim Zeka, who until the moment of appearance in court had refused to release the residence.

Zeka had claimed that Deliu had given 30 thousand deutschmarks because, according to him, Deliu had been authorized by Wessel's residence to sell Zeka at an estimated 85 thousand German brands.

But Deliu had not confirmed any of Zeka's claims, which according to three witnesses had said that he had entered the apartment without any agreement, expressing his willingness to release the residence to Adam Wessel.

After Deliu had freed the apartment, Zeka was located, but Deliu says that this had not happened as the continuator of any agreement between Zeka and him, as the latter claimed.

“Following the statement by witnesses Bektesh Bektesh Bektesh, Hasan Jashar and Refik Miftari, as well as Enver Deliu's statement, who were present when the statement was made by Enver Deliu for the surrender of the residence to Adam Veselin from the Pristina settlement, we have been present and heard from Enver Deliu himself saying he entered the residence of Adam Veselin without any agreement, and for this I am able today to hand over the apartment, but after this residence it's been decided, why I didn't have the agreement that had been put in this apartment, and who had the state of judgment was told.

When Wessel and Deliu had gone to talk to Zeka, he had requested 50,000 marks for the release of the apartment, reasoning that he had made investments in it, or that Zeka gives another 50,000 marks to Wessel and maintain the apartment.

But Adam Wessel had refused to do so, saying that he had bought the apartment for his family.

Periscop has contacted Zeki to clarify the case further. He said there is no such court ruling.

I was buying that apartment which I gave him by my absolute will. We were two buyers of the same apartment that he came in and I left him with a deal of”, Zeka said.

Zeka said he was the cheater in all this. Similarly, the MP said he had freed the apartment immediately after Wessel had asked him for it, despite the fact that, in the act, Zeka reportedly had not done so until the court had made such a decision.

He explains the story in his version, showing how Wessel had gone from Presevo to say the apartment was his.

You know, one day a person comes and knocks at my door, you order me, and he says I'm from Presheva. I heard that these people who sold my apartment were selling it to you, so it's double sell. I'm so excited that I'm dealing with an intellectual man, with a man who knows you in opinion, and I believe we're not going to mind. I said listen to the dude, I buy the apartment, you contract. I'm trusting you even though I don't know you or three people who sell me three, and I don't believe my friends betray me and lie to me. So, you go straight to the justice organs of the court let them prove that you have no problem letting go of the ban and this person when he comes to the court ruling. And this person when he comes to the Court's decision that his father's property belongs to him, not me. The Court has told me that the court has been following these guys for cheating on you because they've been cheating on you, and I don't mind being friends, and I just leave the apartment. That's the real story of this whole apartment”, Zeka said.

Zeka even said that both had owned apartment contracts, but he had never presented his contract to the court until Master Wessel had done it.

The reason I left his apartment was because he bought it in front of me. But we both owned purchase contracts. I'm actually broke by three people I told you.
