NGOs estimate that the president's task officer has no obstacle to decree the chief state prosecutor

Nongovernmental organisations that have monitored the process of electing the chief state prosecutor have assessed that the procedure has been developed transparently, objectively and equally for all candidates, adding that no constitutional or legal obstacles exist for the president's incumbent, Albulen Haxhiu, to decree the nominated candidate for the post.
Volnet Bugakku from the Kosovo Democratic Institute (KDI) said the organisation has positively assessed the prosperity of the process conducted by the Kosovo Prosecutorial Council (KPK).

There are following in extremely transparent and equal approach and it's not noticed any elements of either favouration or even an element to say so during the interview, questions or and interview procedures would be adjusted to any candidate. Today, you have even had yourself completed the candidate voting procedure, and now, normally, it has been left to the president's president or taskman to nominate or decree the candidate for the head of state. And normally we as an organisation call for this process to be completed as soon as possible and not to waste time, even the Republic of Kosovo finally has the candidate for the chief state prosecutor because you know that this position has a long time remaining task leader”, he said.
Asked whether the prosecution of the president's office has restrictions on the decreeing of the chief state prosecutor, Bugakku said the Constitutional Court's judgments have clarified the case.
There is a Constitutional Court act that has made it clear that because of the administration of the justice process, there is actually no limit to the president's duty, I believe there is no problem in simply decreeing the candidate for the chief prosecutor of state. There is no constitutional legal obstacle because you know there has been a process of constitutional amendments then for electing the president and then the court is very good enough to explain that even the leader of the president's office can perform all functions without any problem”, he said.
Even Flamur Kabashi from the Kosovo Institute for Justice (IKD) praised that the process has developed in line with legal and regulatory standards.
Kosovo's <x0) Institute for Justice, as you have seen in co-operation with KDI and FOL organisations, has published a preliminary report with which it has shared as positive assessments by respecting the process, procedures and by complying with standards defined with regulations and legislation in force for the election of Chief Prosecutor of State”, he told EO.
Kabashi said that, unlike the past process, all necessary standards have been respected this time.
“As opposed to the previous process that we've had some issues that we've clarified and that as a result of those shortcomings compromised the process and they haven't given an adequate name, unlike that process in this process we've clarified and pointed out that the procedures are in general, there's after equality among candidates, there's some privacy behind the targets, there's the case of candidates' assessment of the head of state, and the process has been transparent as well as recording interviews, making it public and making it every stage of the competition until now we're talking KKP has repeatedly made an invitation to monitor”, he said.
He added that after Zejnullah Gashi's nomination by the KKP, the process already passes to the presidency.
So today the procedure regarding the post-Kosovo Prosecutorial Council concluded, the Prosecutorial Council nominated Mr. Gashi for chief state prosecutor, now we have the procedure on the president of the state to decree the same.
