Prosecutor's File on Five Indictees Charged to Kill Five Albanian Civilians During War

Kosovo's Special Prosecutor on 1 June has filed an indictment, with proposals for trial in absentia, against five people accused of War Crimes against the Civil People. The incident describes the cruel murder of five civil members of a family.

According to the indictment provided by “Battle for Justice” The accused are: Predrag Nikolic, Zoran Deletovic, Ivan Ivanov, Sinisa Milanovic, and Jovica Deniz.

The indictment says that on May 6, 1999, during the time of the war in Kosovo, in the quality of police officers, the accused have committed actions that are sanctioned according to local laws, customs of war and international Geneva Convention, so in co-ordination they have carried out the war crimes criminal work against the Civil People by Article 142 regarding the Article 22 of Yugoslavia's Criminal Law.

The above-mentioned crimes, the indictment says the accused committed them in the quality of official-copes at the Police Station in Fushe-Kosovo, while on schedule during the night shift, broadcast Klankosova.tv.

The accused, on May 6, 1999, is said to have seen the victims of F.B., L.B., M.B., and S.B., all civilians and members of a family walking on the street.

It is said that Nikolic had told Deletovic to stop the car with the intention of legitimising people in question, taking their documents and putting them in the police car as if they were taking them to the train station.

They reportedly had continued on the road to Slatina, passing through the checkpoint of the Serbian police and army but had not stopped there.

According to the indictment, once arrived at the site called “Meja” the accused had stopped the vehicle, they had ordered the victims to exit the car and accused Deletovic had demanded from accused Ivanov the automatic rifle.

At the same time, accused Nikolic reportedly had ordered the victims to lie face to face and had begun to shoot in their direction with CZ99-type pistol. Deletovici had shot Crvena Zastava with automatic weapons.

The Milanvic and Deniz accused had been present at the scene all along, contributing and helping other accused commit the killings, and then all the accused had entered their vehicle and continued on the road to Lipjan.

The Actakuz says that along the way, Nikolic had given Ivanov the victims' documents, with instructions that he burn them. After that they had returned to the police station in Fushe Kosovo.

Under the indictment and according to the principle of implementing the more favourable law, the law in this case is implemented, which has been in force at the time of the conduct of criminal acts. Therefore, the prosecution has charged the accused with the war crimes criminal act against the Civil People by Article 142 with Article 22 of Yugoslavia's Criminal Law.

While, this work continues to be punishable according to nine 144-147 of the Republic of Kosovo Penal Code.

The prosecution, in the indictment, has proposed that the trial be held in absentia, adding that the prosecution has made all efforts to secure indictees in the procedure and that the same are not found on the territory of the Republic of Kosovo.
