Trump draws $10 billion lawsuit against IRS for any tax crime

President Donald Trump and Justice Department have reached an agreement to bring down a $10 billion indictment he filed against The IRS for the flow of its tax statements from a government contractor, according to a judicial document submitted Monday.

The lawyers of the Trump and Justice Department's legal team did not immediately respond to the requests for comments on the terms of the agreement, but Trump lawyers submitted an announcement Monday to a federal court in Miami voluntarily dropping the indictment he filed in January.

The judicial action came after US district judge Catherine Williams, who is overseeing the case, raised doubts about whether the indictment could continue, since Trump was actually both the plaintiff and the defendant.

Williams had ordered both sides to present official legal arguments on the issue by Wednesday and took the unusual step of appointing foreign lawyers to advise the court on the legal issues involved. It would set a hearing on the matter next week, but Trump's new indictment claims the case is now over as he has the right to bring it down at an early stage without judicial approval.


This development comes four months after Trump, his sons and family business indicted the IRS for $10 billion for failing to properly monitor a contractor who uncovered tax statements by the president and other wealthy individuals in the media seven years ago.

The contractor, Charles Littleleyohn, was convicted in 2023 of leaking Trump statements along with statements from thousands of other wealthy Americans. A federal judge in Washington sentenced him to five years in prison, the maximum he could get under the plea agreement he reached with prosecutors. Littleleyohn has appealed his sentence, arguing he was too harsh.

Trump's civil indictment immediately triggered criticism from the tax world and legal because of the innovation of an issue in which the president is suing the government he leads.

“Although President Trump claims he is raising this indictment to his personal quality, he is the incumbent president and his appointed opponents are subjects whose decisions subject to his” instructions, Williams wrote in a four-page order last month. The “is not clear to this tribunal whether the parties are quite opposed to each other in order to meet [the Constitution's] request on the issue or the controversy. ”

John Koskinen, who led the IRS from 2013 to 2017, said he was concerned about any solution Trump and his family intend to reach the government he leads, especially outside the court's scope.

Immediately after raising the indictment in January, Trump admitted it was unusual to be on both sides of a lawsuit.

The Democrats of the House of Representatives, through their working group for judicial affairs, asked Williams to immediately block any possible settlement agreement that could replace the allies, including nearly 1,600 convicted or charged indictees in connection with the January 6th attack on the Capitol”, according to a legal document signed by 93 Democrats of the House of Representatives and presented immediately after Trump's legal team handed over the release notice.
