DUI: Court and Prosecution not be influenced by political pressures in Artan Grubi case

The Democratic Union for Integration expresses deep indignation at the way a number of political parties have politicised the case of Artan Grub through their public statements and presentations. Despite political differences, it is unacceptable for judicial processes to be shifted from the institutional and legal framework guaranteed with the Constitution and converted into [...] instruments.

Despite political differences, it is unacceptable for judicial processes to shift from guaranteed institutional and legal frameworks to constitutions and turn into instrument of party debate, the DUI emphasises the statement.

The last two days we have seen as political parties, senior officials and their activists create a climate of hysteria and public pressure, announcing attitudes that imply pre-determination.

With this approach they take on the role of the prosecutor and the judge, speak of measures and consequences, even putting pressure on representatives of the judiciary and prosecutor, without respect for the fundamental principle of presumption of innocence.

The fact that such statements come also from parties that are part of the power raises serious concern about possible executive power interventions in judicial processes. We reaffirm our position that any current former or official who has doubts during the exercise of office must face relevant institutions and procedures in the country. In that sense, we consider Artan Gruby's decision to appear before justice bodies and present his arguments under institutional procedure. However, it only makes sense if the state guarantees a fair, impartial and transparent process, free from party influences and political pressures.

We call on courts, prosecutors and all competent bodies to act solely on the basis of law and evidence, not allowing the political climate to affect their work. Independence of the judicial system is a pillar of rule of law and constitutional obligation, not of political interpretations.

We expect the process to develop with full respect for presumption of innocence, procedural rights and the dignity of each person involved, DUI said. The Democratic Union for Integration will carefully follow the entire procedure at each stage and react to any form of selection, double standard or political instrumentisation of justice.
