IKD: Kurti must resign classics, may be both deputy and prime minister

On the eve of the third session for the Kosovo Assembly's constitutionalisation to be held today at 12: 00 p.m., the Kosovo Institute for Justice has held a media conference where it has clarified the situation created in the Kosovo Assembly after the Commission's report on Mandat verification managed to pass. Naim Jakaj from [...]
Naim Jakaj of the IKD, has said it is clear since someone swears as deputy, under no circumstances can be prime minister at the same time.
One thing is clear. From the moment of taking the oath, under no circumstances can a person be members of the government cabinet and deputy, whether prime minister or minister”, Jakaj has said.
“It makes no difference to a regular government or government in office. The KM and ministers, at the moment of the oath, must resign their resignations to the chairman and the administration of the Parliament”, have added it further, broadcasts Periscope.
Jakaj has said that, after the oath, if formal resignations are not deposited, MPs have two mechanisms in their hands, to take him to the Constitution, and to seek constitutional evaluation for the selection of 9th legislature or to make criminal speculation at the Prosecutor's for exercise of two positions at the same time.
In the event of lack of resignations, after taking oath, MPs have two mechanisms available. The first with the constitutional assessment of the constitution for the election of the 9th legislature as envisioned in Article 113 of the Constitution and with a criminal exfiling to the prosecutor for exercise of two positions at the same time”, he has clarified.
IKD's Jakaaj has said that the letter presented by Prime Minister Albin Kurti is an act of resignation and that its contents indicate that Kurti wants to continue leading the government even as deputy.
The letter delivered by Kurti is no act of resignation. His interpretation that his government has the equivalent status of government in office applies to the government as an institution, not to it as its leader.
The letter's contents show Kurti wants to lead the government by being deputy. The prime minister must resign in its classic sense and not interpret his position as such”, he has clarified further.
“Under the Law, the prime minister must resign at the moment of his oath, and the government can't be led by Kurti, the leadership passes to the deputy prime minister and ministerial posts is led by v.minsitrate”, he said.
