The announcement was made Thursday by the chairman of the court, Judge Dealing Shyti, reports “Battle for Justice”, Transmitt Periscope.
In regard to the ruling, the judge announced the parties with the right to complaint in the 30-day legal term to the Court of Appeals, as well as that spending falls on the court's budget burden.
Presequently during this session, it was discussed in regard to Nura's protector's request, lawyer Besnik Berisha, for the unacceptable declaration as proof of the text transcript, as the same were taken without the court's order of retroactive.
On the other hand, Berisha stressed that there has been no decision for this case to start investigations.
In this regard, the prosecutor of the case, Fikreje Feyzullahu, said that for taking these transcripts there was an order.
The prosecutor also pointed out that this evidence is acceptable, as well as confirming the indictment itself, and that on the other hand, all co-accused in this act have been found guilty.
Following the court's consultation, the same took the decision with which they declared the evidence of the message transfer unacceptable.
“Unacceptable transcripts of text transcripts for defendant Hadi Nura are issued because this court estimates such evidence has not been taken according to standards specified with the KPP provisions, as well as constitutional standards now set by the Constitutional Court”, Judge Shyti said.
On the other hand, he added that this Constitutional decision clearly states that for this test to be taken, there must be orders by the judge of the preliminary procedure.
“Phone hearings including phone messages should be made only under the order of the pre-prosecutor judge and the receive of retroactive sms is not allowed because, in an expressive way, the path for wiretapping should be applied from the launch day for the following days”, Shyti added away.
Final words by the parties in the procedure were also given during this session, in which the prosecution demanded the defendant's sentence while protecting his release.
In this case, 11 persons were accused of terrorism, Hadi Nura, Metom Bytyqi, Besim Shaban, Betim Ibrahimaj, Adil Bush, Egzon Latifi, Jatmir Bushi, Artan Kadriu, Bekim Halili, Jeton Aydin and Zejadin Berisha, but the procedure has already been isolated for three of them.
Otherwise, the Constitutional Court in Pristina on July 17th 2018 had sentenced Artan Kadriun to 18 years in prison, Besim Shabanin, Egzon Latif, Adil Bush, Jatmir Bush, Bekim Halili, Cameron Bytyqi, while having acquitted the defendant lives Aydin.
For accused Hadi Nura, the court outside the hearing, he had made a decision to isolate the procedure, which was because the accused Nura was in serious health condition and had to undergo some medical treatments even abroad.
The procedure against Betim Ibrahimaj was earlier isolated since the same is on the run, while then procedures were also set aside against accused Zijadin Bytyqi.
Otherwise, Hadi Nura, Besimi Shabani, Betim Ibrahimaj, Adil Bushi, Egzon Latifi, Jethmir Bushi, Artan Kadriu, Bekim Halili, Zejadin Berisha and Jeton Hajdini are charged that at various times, through Pristina International Airport, they have travelled to Turkey and later to Syria, as having conducted military and physical exercises as part of the terrorist organisation <x0. ISIS”
According to the indictment, May 7, 2015, Hadi Nura, Besim Shabani, Betim Ibrahimaj, Adil Bush, Egzon Latifi, Jetmir Bushi, Bekim Halili, Zejadin Berisha, and he lives Hajdini have fought in Syria for a while, and have later returned to Kosovo.
