Regarding these refusals of Kurt to testify in the Special Prosecutor spoke in an interview for Euronews Albania, former head of the Constitutional Court of Kosovo, Mr Enver Hasani.
He said Kurt's refusal to testify is unacceptable and promotes citizens' inequality before the law. He described this act as political hooliganism, while showing the details of why, according to him, Kurti refuses to testify.
The refusal of Kurt to go to Special Prosecution is an ugly thing and implies violation of the rule of law, because it sends a wrong message to ordinary citizens, promoting the inequality of citizens before the law, against the situation that no one is above the law. On this basis, it currently rests on the law, as it has not won the battle with the state, because no one can win it, so neither can Mr. Kurti win it”, Hasani said.
According to Hasani, Kurti has signed for state reserves himself and that is the main reason he will not testify, as he may end up under the indictment.
“Witnessing is the legal and constitutional obligation for each individual, including the prime minister. The main reason he doesn't go there is another fact he knows: he signed for the reserves. Do they know that all those decisions exist and that part of them are public, past with his signature and with his permission? He knows that after this testimony, even Mrs. Derona Mihali, who is in a grey entity here in Kosovo, may end up under the indictment. This is the real reason why Mr. Kurti refuses to give the testimony”, he added.
Also, Hasani said Kurti would not escape the rule of law, however long it puts off default and said that, initially, a fine of 250 euros and then by force.
If not wrong, the initial sentence is 250 euros and if it continues with refusal, the court orders Mr. Kurti's arrest and violent behaviour. This kind of institutional hooliganism is unacceptable in this part of the world where we live and intended to form political by the highest standards of our constitution and Western countries. This is an unacceptable move and will have consequences for Kosovo and for Mr. Kurti, because he is objectively unable to challenge the endless failure to testify”, Hasani said. /euronews.al/
