Appeal confirms the Foundation's decision, remains in effect the indictment in the case of “Banjska”

The Constitutional Court in Pristina, with the ruling of December 6th, 2024, had refused requests for an indictment of the indictment and objections to evidence submitted by defenders of the accused above against the Special Prosecution Act of the Republic of Kosovo, reports the “Battle for Justice”.

Also, the court college has estimated that there is no evidence that can be considered unacceptable or that has been assembled in opposition to the KPP legal provisions and that none of the legal bases have been identified that could justify the exemption of evidence, as required with Article 243, paragraph 1, subparagraph 1.1, 1.2 and 1.3 of the KPP.

So far, arrested and under detention for this case are: Blagoje Spasojevich, Vladimir Tolich and Dusan Maksimovic, for whom criminal procedures have been isolated.

In the initial review held on October 9, 2024, three defendants have been declared innocent, broadcast Periscope.

Special Prosecution Act charges 44 physical persons and a judicial person “RAD D.O.O.” The list of indictees leads Milan Radojic.

The Special Prosecutor of the Republic of Kosovo (PSRK) on September 11th 2024 has filed charges against Milan Radojicic and 44 others for the September 24th 2023 terrorist attack in Zvecan Banjska. The accused are charged that, through the use of heavy-armed violence, they tried to exhumate the northern part of the territory of the Republic of Kosovo and unite the Republic of Serbia, with cases as a result of the violence used has remained the death of police official Africa Buxaku, and the lives of other police officials and the civilian population were risked.

On the other hand, the leader of this structured terrorist group, Milan Radoic, is charged that from 2017 to September 24, 2023, it has provided indirect income, and it has converted it into real estate and playful wealth, where some of its real estate has transferred it to third persons with the aim of hiding or hiding the source of wealth.

The 45 accused are charged with criminal acts “carrying out terrorist activity”, “Heavy works against the constitutional order and security of the Republic of Kosovo”, “Reforstation and financing in carrying out terrorism” and “Money expand”.

Always according to the indictment, the attack has continued until 1500 p.m., when the destructive majority of this group have fled to the mountainous roads to Serbia, all in order to seriously destabilise and destroy the fundamental political, constitutional, economic, social structures of the Republic of Kosovo.

Therefore, these same actions are being tasked with the launch of terrorist activity “sanctioned with Article 129, paragraph 3 concerning paragraph 1 related to Article 128, paragraph 1,point 1.1, 1.3, 1.7 and 1.10 of the Republic of Kosovo Penal Code (KPRK).

What is Milan Ranovici accused of?

The third and fourth suit of the indictment only charges accused Milan Radojic. He is charged that between 2017 and September 24, 2023, in the quality of the leader of the structured terrorist group, has provided indirect income.

According to the indictment, most of them have been used for heavy weapons purchase and supply of heavy weapons to the terrorist group, military uniforming of uniforms for group participants, logistical support, equipment and logistical services for group operations, the payment of participants to the group's funding members of the terrorist group. All of this to ensure their continued involvement and commitment to criminal activities, actions with the aim of facilitating and financing of terrorist acts, resulting in the establishment of capacities needed to carry out terrorist acts.

Therefore, for these actions, Radoicic is being tasked with criminal work “Fugitation and financing in carrying out terrorism”, sanctioned by Article 131 of the Criminal Code regarding Article 57 of the Law for preventing money laundering and fighting terrorism financing.

And in the fourth device, Radoicic from January 1st 2017 to September 24, 2023, knowing that a portion of his revenues stem from criminal activity defined as the III point of device and other criminal activity, through the cooperation and assistance of defendants Radule Stevijq owner and a manager of the RAD D.O and Radule Stevic businesses, B.I.I. and their economic activity, this money has converted into real estate and play, where some of the real estate has transferred to the third persons of hiding, or source.

Therefore, for these actions, Radojciac is being charged with criminal work “Money laundering” sanctioned with Article 302 of the Penal Code regarding Article 56, paragraph 1, subparagraph 1.1 of the Law to prevent money laundering and combat terrorism financing.

Fifth device charges judicial person “RAD D.O.O.” for money laundering

What Radule Stevic is accused of, the person responsible for “RAD D.O.O.”?

The last indictment device charges the legal person's owner “RAD D.O.O.”, Radule Stevic, that given that defendant Milan Radojic's wealth stems from criminal activity, the same through businesses registered in his name and their economic activity, has co-operated and helped defendant Milan Radojciq convert his wealth, with the aim of hiding or hiding the source of wealth.

How do witnesses describe the critical day?

In the 158 - page indictment, witnesses (police officials) on the critical day had reportedly heard two explosions and then started shooting from the monastery in their direction. At that moment, they saw Sergeant Bulnjak lying down after he was wounded and police officials had begun responding to the shooting.

The shepherd had been driven away by a car that had been shot several times by the attackers.

A North Macedonian citizen, who was in the Hotel “Rajska Banja” that day along with his wife, minor son and sister and husband's sister, said that around 3:30 a.m. they heard gunshots and explosions.

After having dawned, he said that they had heard the first sound of uniformed people with guns there. Said they weren't allowed to leave the hotel. At the beginning of the shooting, the hotel was filled with people.

However, Rade Nedelkovic-worker at that hotel had said that four armed men had gone there that day, three of whom were carrying an injured person. And then one of those people's dad called him to ask him his last name was Sliveq.

E Veljo Ilic has declared that his son, Vladan Ilq, had called him on September 24th, asking him to go get him to the hotel. Later, he had contacted her again by telephone and said she had gone to Serbia through the mountain about four and a half hours on foot.

The Witness had said that he knew his son was part of the “Civil Protection”, where he was paid around 400 euros.

On the other hand, witness A2 had declared that near the border with Kosovo, at Rogozna that day, he had seen many vehicles without license plates, and some with BG license plates. He had seen 15 armed men arriving from Banjska who had participated in the terrorist attack.

The attackers, according to him, came from the monastery received by two cars. He said 25 or more uniformed persons have moved from Kosovo to Serbia.

Witness A2 has said the group worked a year before the attack by attackers working in Serbia's Army. He said he heard that Radochi's gone to Russia.

Witness F1 has said that Radoic has organised and armed these people who had long exercised in Serbia, and most of them have paid between 2,000 euros a month. He said that “went with the idea of releasing the northern part of Kosovo”.

The fugitives, the F1, said they are in Serbia and have contact with Radociqi. For the latter, Aleksandar Vuciq said his money is due to crime, smuggling, tenders and financing.

What was the argument of the three defendants in custody?

Defendant Vladimir Tolich, in the Prosecutor, has been quietly protected. But in his jacket, the presence of nitrites and nitrates has been observed from the remains of gun shooting, which according to P. SRK's showing he took part in the attack.

Blagoje Spasojeviqi, on the other hand, said that “thought there would be a peaceful protest”. But he has been forced to obey Momcilo Vuckovic's orders.

He said he'd stayed behind the monastery and never fired a gun. Kosovo police had arrested him there.

Dusan Maksimovic (worker of the Riceka Banja Hotel) has said that eight friends were gathered on a weekend-long barbecue.

On the phone, he had videos of the attack on the Police and Police Monitoring, so he said that “does not remember”.

The prosecution says telephone communications directly incriminating it into criminal acts, such as critical day messages: “Write here.

When is it claimed to be the beginnings of the attack?

According to the prosecution, the beginnings of organisation- preparations for the attack began from the meeting held in Serbia's District, on 13 October 2021, where it was called for support in order to carry out serious criminal acts.

Serbian President Aleksandar Vuciq, Vladimir Radojevic's Milan Radivojevicc, under the nickname “Mama”, as well as high state structures. At the meeting, he was asked to arm himself and start armed resistance against institutions in four municipalities in northern Kosovo.

You heard these brave guys say, I'll tell you one thing on behalf of all of us, that next time we'll defend ourselves to the end, by the death of”, Radocic said at that meeting.

KFOR Police attacks in 2022 and 2023, reportedly were also organised by Radociq. The latter, with the heavily armed group on December 10, 2022, were photographed in northern Mitrovica.

E - equipment examinations showed where the terrorist group stood and where it performed the exercises. These devices also showed the realization of the attack plan, from the establishment of trucks as barricades, the transport of attackers, their stay at the hotel, the moment of attack on police, and so forth.

Who and how did Radichi finance it?

Regarding Radojic's financing, the prosecution stresses that during the investigation it has proved that its empowerment has been done in different ways with Serbia's direct support, originally through tenders and then with political support.

“Later, Serbia has offered all necessary military infrastructure for the training of participants, providing military and logistical equipment -- all necessary to carry out the September 24th 2023 terrorist attack on the Zvecan Banjscan of the Republic of Kosovo” -- is said in the indictment.

The collection of funds was reportedly made by opening legitimate businesses, with the aim of hiding the origin or storing the origin of money.

Any institutional support offered by Kosovo's budget for citizens of the north has ended up in the hands of defendant Milan Radoiić, where the same had managed to create businesses that were seen as legitimate and won public contracts”, the indictment says.

Factal owner of businesses opened on behalf of Radule Stevic is said to be Radojciq himself. So its two sources of funding were reportedly misusing tenders in Kosovo and financing from Serbia.

According to the PSRK, tenders won in Kosovo were lower, so it received contracts that were legally legal, but after receiving the tender, the project was not implemented at all.

The second or most basic form was through financing from Serbia, where this form worked on behalf of the so-called “Zyra for Kosovo and Metohi”. The contracts were won on behalf of registered businesses owned by Stevichi.

“During the analysis and comparison of each of these contracts, this prosecutor has concluded that “DO. RAD 028 Zvecan” registered in the parallel system in Serbia has to obtain 192 contracts (the two contract groups) for the 2020 period of 31.07.2024, where the total of these contracts amounts to about 67.5m euros, or in the Serbian dinar 7,939,807,482.6011), is said in the indictment.

Also, contracts have been provided on behalf of the financing of various projects, as well as seedlings, livestock and agriculture equipment, housing construction, and so forth.

“From this scheme is seen as defendant Milan Radoiić through defendants Radule Steviq was financed in various forms, profiting money in the name of Serbian citizens from Serbia, Kosovo-funded tenders for creating better conditions for Serbian citizens, and then using all this economic power to employ defendant Milan Radoiić to the citizens of the northern part of Kosovo, deciding on every issue, forcing them to carry out smuggling with goods, blocking roads, rebeling the barricades, setting up barricades, and funding basic needs for the basics over the north of Kosovo, and the constitution is said in the case.

The prosecution points out that most of these companies were founded before the attack on Banjska. Their profits from donations have fallen into the hands of Radojchi, Stevijqi, other members of the terrorist group and their family members.

Regarding tenders won in Kosovo, it is said that the company does not have the capacity, nor does it have the workforce and machinery to implement contract-earned projects.

According to the prosecution, it has been proven and confirmed that defendant Milan Radoic, consciously, through criminal activity, has created inflows of millions of dollars and this through businesses registered on behalf of other defendants Radule Stevic ( RAD 028 Zvecan, RAD DOO, RADULE STEVIC B.I.) has disguised the origin or background of money and again through Stevic's businesses has converted them from financial means to playable and real estate.

The guards of Radojciq's villa at Weiman, originally with his instructions, had said the owner was Bojan Jaksic, and later admitted to being Radojciq. They said the salary was taken to the restaurant “Grey”. On the other hand, witnesses who were engaged in the construction of the villa had testified to the building material that was sent, who was responsible for building the villa, some mentioned Radoiciqi and other details.

Radojic's former partner, Emma Redzepovic-Radoicic, has said that the 800-euro rent for the apartment in which he lives pays Radojic, with which he rarely communicates. He said he was a good father, but not a good husband.

For the villa at Weiman, she said she doesn't know how much Radojic invested. The office at the “Grey” restaurant, Emma said it was on behalf of her mother, since she couldn't go and sign the contract.

So far, in custody for Banjska's race are Vladimir Toliq, Blagoje Spasojevic and Dusan Maksimovic.

In Baysnka, Zvecan, in the early hours of September 24, 2023, was killed by Sergeant Africa Bulnjak and two others were injured. Then there were three attackers left, while others had fled for several hours to the Biensca Monastery. Milan Radociq had claimed responsibility for the terrorist attack.
