Out of 16 years in prison for murder, the prosecution calls for increased sentence in Appeals and defence reduction

The Appeals Court reviewed complaints about the sentence of Agron Vlasaliu and Arlind Ahmeti, who were sentenced to 16 years in prison for criminal work “Cause of total risk”. At the session, complaints were reviewed by the Pristina Constitutional Prosecutor, the damaged party and legal representatives, including lawyer Fanol Krasniqi and defenders of the accused, Arlind Ahmeti, lawyer Asdren Hoxha, as well as Agron Vlasaliu, lawyer Florent Latifaj.
In October 2024, Vlasaliu and Ahmeti have been sentenced to retrial of 16 years for the murder in downtown Pristina.
Initially, the head of the college, Judge Zydiah Haziri, opened the session and asked the referred judge, Gevdet Abazi, to present the case, reports “Justice bet”.
Judge Abazi explained that against the Constitutional Court's decision in Pristina, the Constitutional Prosecution has filed complaints, demanding that the accused be found guilty of criminal action “grave murder” and not “Cause of total risk”.
Likewise, the party's representative, lawyer Krasniqi, has filed complaints demanding that the prosecution's request be approved. He argued that the decision stresses that there was only one communication between the injured and the deceased, while the subject paperwork is understood to have had more contact.
On the other hand, lawyer Hoxha stressed that the Court of the First Stairway has pronounced very high sentences, calling for Apel to review the element of co-ordination among the accused and assess extenuating circumstances.
Lawyer Latifaj argued the two indictees were found guilty of arms maintenance for the same weapon, which, according to him, is unacceptable and cannot bring penalties for both.
At the end of the session, Judge Haziri announced that the parties would be long informed of the Court of Appeals' ruling.
Initially, the Constitutional Court in Pristina, on 16 April 2019, after requalification of the criminal act, convicted Arlind Ahmeti of pushing him to serious murder, condemning him to 17 years in prison. Meanwhile, Agron Vlasaliu was on the run.
The Court of Appeals, in November 2019, ruled that the case be retriald by the Court of First St.
On December 13th, 2022, the Constitutional Court in Pristina again pronounced a condemnation of accused Agron Vlasaliu and Arlind Ahmeti, condemning them to 21 years in prison for serious murder in co-ordination against the late N.S., in 2017 in Pristina.
Meanwhile, the Court of Appeals, on March 23rd 2023, after reviewing complaints by the representative of the damaged parties, lawyer Nexmedin Sejdiu, and defenders of the accused, Asdren Hoxha, Fitim Malocaj and Florent Latifaj, reversed the Constitutional Court's conviction in Pristina and reversed the case for retrial.
According to the indictment, filed on July 13th 2021, Agron Vlasaliu is charged with being charged on November 24, 2017, under a preliminary agreement with defendant Arlind Ahmeti, have now deprived the deceased N.S. of life. and have risked the lives of the injured Behar Sahiti, Lumbardh Kukaj, Freshim Fariz, R.K. And exile Kqiku.
