From the moment of Tirana's mayor's arrest, nine months have passed and continues to be regarded as pre-prisoned, but Erjon Veliaj insists his grip is unconstitutional.
With such an attitude, the mayor's lawyers handed over to the Constitutional Court the request for abolishing the arrest measure in effect by the three-degree judiciary.
The first argument is about non-proposition, while, as constitutional court sources suggest, lawyers have also attached concrete verdicts. Their goal to illustrate to the constitutional judges that there are no conditions to investigate the arrest.

Three weeks earlier, the constitutional court gave the mayor of Tirana the right, bringing down the government that had dismissed him and rejecting the president's decree to hold partial elections in the capital. The decision was handed down by five votes for, while it was stressed that an unfair legal process was held against Veliaj.
With a constitutional order declaring the return to office with Erjon Veliaj, the criminal process based on SPAK investigations continues in the anticorruption court not only against the official, but also 29 other defendants among them businessmen and 12 are non-profit organisations whose funds were allegedly approved that, according to the SPAK, ended at Ayla Xoxa and close persons.
