The prosecution against accused Shala has been declared by the court of the case Tuesday, Marigona Lajci, reports “Justice bet“.
Under the trial, accused Leotrim Shala was found guilty of criminal acts “Suicide push and suicide aid”, and the same was pronounced a four-year prison sentence.
In the prison sentence, the accused will also be counted as having spent time in custody and in house arrest until the full might of this act, but no longer than the stated sentence.
The accused is obliged to pay the expenses of the court procedure, and on behalf of the judiciary, the amount of 100 euros and another 50 euros on behalf of the fund for crime victims.
The court, the parties damaged to implement the property-law requirement, instructed them to civil disputes.
Judge Lajci said during the verdict's statement that the court on the retrial case has taken into account the remarks and instructions of the Court of Appeals, especially in terms of assessing the statements of several witnesses and statements of the accused, given in the police.
She said that since in the last trial the case has been tried by another judge and with the aim of accurate and correct confirmation of the actual situation, all witnesses have again been prosecuted, including new evidence that has been presented in this judicial review.
On the other hand, the judge stressed that the accused is guilty of the work that is placed on him has been confirmed by witness statements as well as by the now - felt communications with her friend in Instagram (where she had told him of the persecutions the accused had already experienced). He also said that communication between the accused and now the deceased have been appreciated, where after a disagreement he had ended and reviled the victim.
Regarding these communications, Shala had admitted to the police that she had now felt earlier, saying that she was serious but that she had done so that the dispute between them might not become too big with family members. Further, she said that the accused had admitted that she had already been influenced by her feeling of quitting and had stopped contact with her friends, reasoning that they are not good, and that her work environment has not been good.
During the proclamation, the judge also stressed that the accused had said that even earlier the deceased had shown concern that he is thinking suicide. Therefore, because the accused has been aware of the now felt unstable situation and has again pressured the same until he has come to commit suicide, the Court holds the accused responsible.
Further, it was said that the fact that the accused now felt only two hours before the critical event had been at odds until B.I. was preparing for suicide, summons the accused, and during the video call committed the act of suicide, this circumstance in connection with other circumstances has no other interpretation than that the suicide victim committed it by being driven by the accused.
On the case of the sentence, it was said that the Court has taken into account all extenuating and demanding circumstances.
Otherwise, present in the proclamation were Prosecutor Aytane Zoni, and the representative of the damaged party, lawyer Thank you Syla.
Against this act, the parties have the right to a complaint at the Court of Appeals in the 30-day deadline from the day of its admission.
Otherwise, in the first trial, accused Leotrim Shala on December 4th 2023 had been acquitted of having failed to prove that he committed the burdensome criminal work.
But, against this act of complaint at the Court of Appeals, the Mitrovica Constitutional Prosecution had exercised, and after reviewing the complaint, on August 8, 2024, Apel annulled the first degree act and turned the case into retrial.
The Constitutional Prosecutor in Mitrovica on March 6, 2023, has filed charges against defendants Leotrim Shala, who was charged with having now urged the late B.I. to commit suicide from December 30th to September 8, 2022.
The indictment reportedly states that defendant Shala, during his relationship with the deceased B.I., had consistently beaten, mistreated, injured and prevented him from working, socialised, and visited her relatives.
All in accordance with the indictment, the defendant Shala's superior actions had caused high psychic pressure at the late B.I., which on September 8, 2022, had now called defendant Shala and committed suicide.
With these actions, Leotrim Shala was accused of committing criminal work “Suicide push and suicide aid” by Article 177, paragraph 1 of the Penal Code of the Republic of Kosovo
