By means of two separate decisions, on January 13th 2025, the court has also ordered the Specialised Prosecutor's Office to file a letter through February 21st 2025 its premonition for the upcoming review of the detention measure for the two accused, reports the “Bet on Justice“.
As with Krasniqi, for Selimi, the panel has concluded that at this moment there is not enough information showing that accused can evade justice. However, there is a danger for both to hinder the progress of procedures, as well as to commit other crimes against those perceived as KLA opponents, including witnesses.
In both decisions, Z The SP has indicated that no change has taken place since past decisions on continuing detention.
In the course of all this, the SPS has argued that detention for the two indictees remains proportional.
However, the panel has stood that none of the previously proposed conditions and no alternative measure could effectively manage the existing risks related to the accused except keeping them in the detention facility.
The panel finds that the risk of obstructing procedures and committing other crimes can be managed only at this stage of procedures, if Mr. Krasniqi remains at the KPS detention sites. Under these circumstances, the panel finds that there are no alternative measures that can sufficiently manage risks in line with Article 41 (6) (b) and (ii)”, the decision on Krasniqi, similar to that of Selimi, says.
As a result, the court has ordered continued detention for Krasniqi and Selimi for another two months.
Otherwise, the Specialised Prosecutor's Office, on September 30th, 2022, has handed over the confirmed amended indictment against Hashim Thaci, Kadri Veselini, Jakup Krasniqi and Rexhep Selimi, which consists of ten points of charges, where the latter are charged with war crimes and crimes against humanity.
On April 29th 2022, the Specialised Prosecutor's Office had handed over a amended indictment to Hashim Thaci, Kadri Wessel, Rexhepi and Jakup Krasniqi, where four indictees have committed war crimes even in Gjilan, Budakov and Semtish.
On November 9th 2020, in their first appearances, Hashim Thaci's Jakup Krasniqi has been declared innocent of the charges placed on them. Wessel has also been declared in his presentation on November 10th, as has Rexhep Selimi on November 11th.
