The new act, established against former President Hashim Thaci and four other people, has been praised by lawyers, as dry, without evidence and unclear. The new Act of Prosecutor's Office specialised to former President Hashim Thaci and even to Isni Kilajt, Bashkim Smajt, Fadil Fazliu and Hajredin Kuci has been praised dry by lawyers accredited at The Hague tribunal.
Three counts of attempted obstruction of official persons in carrying out official duties have been filed against Thaci, four counts of violations of the procedure's secrecy and four counts of disobedience to the Court.
According to attorney Artan Cerkini, the content is clear and does not present the evidence.
So first it should be seen that those wiretapping referred to in the indictment were taken legally or not. Then it is also noted that the indictment is not clear enough. The evidence was just mentioned, but it wasn't shown. So no proval value is known. And also, the indictment is edited in parts that make it even more unclear”, Cerkini said about KOHA.
According to the indictment, during the time of being visited in custody, Thaci has given guests confidential information for SPS witnesses Kilajt, Smajt, Fazliut and Kuci from April last year until this year's November.
The Special Document says that all four Thaci had given instructions and details on how to influence witnesses, and that they agreed with instructions.
Lawyers differ on whether, in case of confirmation, the new indictment will drag out the main judicial process against Thaci and others, accused of war crimes.
Lawyer Amer Alija denies the possibility of such an impact.
The “won't drag back into the court process against Thaci, which is projected and its length is nearly calculated by the juro for how long it will continue. There are several deadlines to be carried out with the hearing of its witnesses, where by April of next year all witnesses proposed by the prosecution should be heard. And, of course, parallel to this procedure, from time to time hearing about this new indictment, of course, if it's confirmed”, Alija said.
The opposite was highlighted by the lawyer Cherkini.
It can definitely affect procrastination, because in the first criminal case it cannot be held without Mr. Thaci's presence. Thus, Mr. Thaci will already be distracted, so he will be confronted with two court processes, and that will affect the quality of his defence and also the procrastination of the procedure”, he said.
According to the new indictment, three Thaci groups have worked: Group “Smaj” consisting of former advisors Union Smaj, Artan Behram and Blerim Shala; The “Kilaj” group consisting of Isni Kilajt and Vladnim Kryeziu; and Group “Fazliu”, composed of Fadil and Fahri Fazliu.
Kilaj, Smaj and Fazliu were arrested Thursday, while on Friday they were sent to The Hague. At the same time, Kuci has been cleared for “submitive”.
