Serbia has no jurisdiction nor judiciary nor territorial authority over Kosovo since 99. Even without Kosovo being declared independent in 2008, Resolution 1244 has taken any kind of jurisdiction at the time to Yugoslavia and has initially established competencies within the civilian and military presence, and by 2008 the only state that has jurisdiction over this territory is the Republic of Kosovo, confirmed by the International Court of Justice. These are trends, Serbia's tactics to destabilise Kosovo and the region, and what is best witnessed through these actions is that Serbia still has the mind of the 1990s, a mind intended to destabilise neighbouring states, yet the reality is irreversible and unchanged and Serbia will not achieve anything with this”, Osmani has said.
The Serbian government has adopted a bill for, as it has called the organisation and competence of Serbian judicial authorities in the pursuit of criminal acts committed on Kosovo's territory. In addition, it has adopted a decision through which it declared Kosovo as the “area of special social protection”.
And, meanwhile, despite international criticism, the latter failed to persuade Serbia to give up. Official Belgrade has expressed its position that it will keep in force the decision to declare Kosovo “the particular social zone” and that it will adopt the Law on jurisdiction on criminal acts in Kosovo in the country.
