Charged for failing to announce the preparation of the terrorist attack on the Israeli National in 2016 reached plea agreement

This agreement was reached at Tuesday's session at the Pristina Foundation Court, reports “The Justice Vow”.

Hoxha is accused of being aware of the terrorist group's prepared actions for a terrorist act against the players and fans of the National of Israel in 2016, but did not report competent organs.

The case attorney, Bekim Kodraliu, stated that after reviewing the request of the defendant Hoxha's defender, attorney Asdren Bytyqi, and after authorisation by Special Prosecutor Chief Prosecutor Blerim Isufaj, the plea agreement has been reached.

The prosecutor proposed that the court, in the case of the conviction against the accused, pronounce a sentence of 1 year and 6 months to 2 years in prison.

Also, prosecutor Kodraliu demanded from the Court that the house arrest measure be continued to the accused until the full might of this act, as well as the same toʹte pay the procedural expenses.

On the other hand, lawyer Bytyqi demanded that this plea agreement be accepted as legal, arguing it was voluntarily reached by his defence. He asked that the lowest punishment be pronounced.

The same “has been voluntarily achieved by the defendant and is in line with law”, lawyer Bytyqi said.

The judge of the case, Nundman Beqiri, in advance informed the accused of his legal rights and asked him if he is familiar with the contents of the agreement. Hoxha confirmed he's aware.

The “I stand as a whole near the deal... the negotiation we have behind is clear, I stand behind the statement I have given... this agreement I have voluntarily made”, said accused Hoxha.

Otherwise, the November 8, 2024 session has not been held in the absence of indictees Hoxha.

The act, set up on October 22nd 2024 by the Special Prosecutor of the Republic of Kosovo, charges accused Hoxha that during October-October, early November 2016, she met and participated in ongoing discussions with now V.I., B.I., L.V., F.G., K.P.P., A.A., L.G., L.M. and B.P, for criminal acts of terrorism under the Constitutional Court's conviction in Pristina. Hoxha has been aware of the existence of this terrorist group and the preparation actions she has planned to undertake in carrying out the terrorist act -- the explosive attack on players and fans of the Israeli National Football Club in the match that will take place in Shkodra on November 12, 2016.

The Actakuz says that with the reaction of Kosovo's justice bodies and thanks to international judicial co-operation, the attack had been halted, while accused Hoxha had been informed of these acts of this terrorist group, had hidden it and had not announced competent organs.

With these actions, he is charged with committing criminal work “Hide or not to warn terrorists and terrorist groups” from Article 142, paragraph 2, regarding Article 385, paragraph 2, subparagraph 2.4 of the Criminal Code.

By the indictment, The PSRK has conducted criminal investigations against indictees, Hoxha, due to suspicion that it committed criminal acts “preparing terrorist acts or deeds against the constitutional order and security of the Republic of Kosovo” and “Organising and participation in terrorist group”, but following the development of investigations and statements by indictees Hoxha, it proved that it has consumed elements of criminal work <x> The secrecy or failure to warn terrorists and terrorist groups”. That the accused committed the criminal offence for which he was charged is said to have proved quite clear and convincing by the evidence attached to the subject papers, such as: Criminal charge, Kosovo Police Intelligence Report, statements by suspects L.M., K.P., B.I., the informative report on the implementation of the control, etc.

In the indictment, the defendant reportedly, during his statement to the Kosovo Police as well as to the Special Prosecutor of the Republic of Kosovo, in the presence of the lawyer, has claimed to have been in the company with some of the persons already convicted of terrorism and has been aware of their actions to be undertaken for terrorist attacks as revenge for the war in Syria at the time. During his statement, he had reportedly pleaded guilty to failing to acknowledge the criminal act of terrorism and had repented.

“As for criminal acts the preparation of criminal acts and terrorist group organisation, I feel completely innocent”, he had declared.

While for the equipment found in his house, he had declared that he did not have any terrorist act.
