“Brezovica 1”, Environment Ministry official sentenced 5 thousand euros in fine after admitting guiltyness

Thus, the Constitutional Court in Pec has declared condemnation of the Chief of Environmental and Water Protection at the Ministry of Environment, which is accused of failing to take action to halt construction near the river in Brezovica.

This announcement was issued by the chairman of the court, Nushe Kuka-Mekaj, who said the accused Hyseni, because of his health condition, had given up on the detention hearings, but remained close to the plea agreement.

At the November 4th session, the court had approved the plea agreement linked between the accused Mustafe Hyseni, his defender Ymer Huruglica and prosecutor Rasim Maloku.

Under the same court agreement, he had declared a six-month prison sentence, which, with the consent of accused Hyseni, turned into 5 thousand euros in fines.

According to the indictment, accused Hyseni and Halimi are accused of failing to fulfill official duties, in the way they have not undertaken legal-ekusive actions to prevent weekend construction and hotel facilities in “National Park. Sharri”-wine the Brezovica area, even though they were aware the objects were being built without environmental consent and in the vicinity of the river.

Also being commissioned for construction in the second area of Park after inspectors had carried out the inspection of construction around the Source River (Murzhica), which were being built in opposition to the Kosovo Water Law, the Law for Environmental Protection, the Law on Environmental Influence Rating, the Law for National Park “Sharri”, as well as the Space Plan for the same park.

As a consequence of this misaction, according to the indictment, hotel objects and NNN house weekends “were built. Stella Consuling”, hotel object “Rimida” and weekends owned by Rijad Hasani, hotel facilities “Rezonence” (now “Brezovica” owned by Arian Idrizaj and “Kayna Hotel”, as well as NNx10 house weekend). Hit-amperial” owned by Fatmir Grainca, NN “Hic-Holing” owned by Naser Kelmendi, NN “Finance”, as well as those of Brian Imer.

With this, Citaku, Halimi and Hyseni are charged with committing criminal work “The use of official position or authority” by Article 422, par.1 linked to par.2, subpar.2.2. of the Criminal Code of the Republic of Kosovo.

Halimi is also accused of failing to issue the decision of August 6, 2020, with which the administrative establishments of the Environment, Water, Nature, Space Planning and Construction Instigation, as well as the second degree decisions of the MMPH commission, with which decisions had been halted in hotel construction facilities of “Rock” owned by Hyseen Aydin owner NN “Stella Consulting”, NN “Kaona Hotel”, as well as owner Fatmir Grainca's weekends, Runzhdi Aliu, and others.

According to the indictment, these decisions were reportedly issued after the extraordinary inspection of the Ministry's Inspectorate, in co-operation with the State Prosecutor and the Directorate of Reform Crimes in Pristina.

With this, Halimi is accused of committing even criminal work “Use of official position or authority” by Article 414, par.1 of KPRK, which is sentenced to imprisonment of one to eight years. /Betimi for Justice/
