Minister Roseta Hajdari made that decision on 21 August, 2023, while arguing that local production does not cover market demand.
“... it seems that domestic production does not meet the main condition for protection with the Antidamping measure because we have changed food prices concentrated for birds and animals on the market, where Serbian products in Kosovo that are considering this measure are more expensive, and the amount of production of this product is less than 50% of the total production of similar products, that is, production of this product has failed to meet the condition that is envisioned in paragraph 6 of Article 28 of the Law. 04L-240 for Anti-damping measures and counterbalancing measures”.
The 21 August decision was made under a final “analyze” of March 29th of this year, which, according to MINT, “redirects the interruption of Serbia's anti-damping safeguard clause over the production sector of the Koncentra for birds and animals”.
The decision signed by Minister Hajdari also says that the demand will be considered by either the local industry of Kosovo on behalf of or on behalf of Kosovo's local industry only if it is backed by “Kosovar producers whose production represents equalities or more than 50 per cent of the total product's similar production”, or “if the opposition expressed to Kosovo producers' application is less than the production of these producers supporting the” requirement.
“The Ministry of Industry, Enterprises and Trade in consultation with the Commission for the Education Measures of Imports, based on Article 46 of Law No. 047-240 For Anti-damping Measures and counter-mandaging measures, as well as the analysis of data from this commission, which was presented as the final analysis of the 2903.23 date, recommends cutting off the anti-damping safeguard clause over the Concentra's production sector for birds and animals based on upper data”, the decision said.
October 2021, the ministry in question had imposed protection measures against several Serbian companies, which make import of the concentrations for birds and animals, as well as import of the blocs.
The temporary 3-center anti-dumping measure was set for these companies: FSH “Sto Posto” and FSH “Becejka”.
These decisions are said to have been made after the demand of local producers.
After the request of local producers and the Commission's Proposal on Special Obligations in Imports, the Department of Commerce has begun investigating imports from Serbia and selling to the Kosovo Republic market for birds and animals. The investigation was conducted in accordance with the Law on Anti-Magging Measures and Anti-balancing Measures”, the Ministry of Industry, Intervention and Trade said.
Minister Hajdari had declared that they have made two decisions for anti-damping protection measures against specific products imported from Serbia.
Hajdari indicated that decisions involve importing the concentration of animals and birds until the other for the building block units.
“Today, October 8th, we have made two decisions for anti-damping protection measures against specific products imported from Serbia. One decision sets the 3-center-pound antidamping measure in imports of the concentration of animals and birds from Serbia. The next decision sets a 3-center anti-damping measure for units of Serbia-born construction bloc”, Hajdari said at the time.
According to her, two decisions have been made in accordance with the Law on Anti-damping Measures.
“Decisions have preceded separate investigations and real analysis of the trade department, which has acted according to local manufacturer's demands. The launch of investigations is particularly based on the commission's proposal for assessing specific obligations in imports. Investigations have confirmed that products in question are sold at a lower price on the Kosovo Republic market than on Serbia's domestic market as the country of origin”, Minister Hajdari declared October 2021. /Periscopi/
