This court has confirmed the establishment of the Constitutional Court of August 6th 2023, with which the detention measure was scheduled for 30 days.
The Court of Appeals has stressed that the Constitutional Court has justified the paperwork and that there is so far the suspicion that defendants have committed the criminal acts they are suspected of. Also, the ruling reportedly has met the legal conditions for the appointment of the detention measure.
According to the Prosecutor's File, Andy Pajaziti, Gezim Zakuti, Dukagjin Nikolaj, and now late Kastriot Ramadani, along with a still unidentified person, about 23:17 on August 4th, were at the “Ban Vivant” locale.
Kosovo police have announced on August 11th that they have declared Dukagjin Nikollaj on the run, under suspicion that he has committed four different criminal acts and that the same was allegedly involved in the “Ban Vivant” case.
The DA's file explains the moment the parties pulled out the firearms and started shooting at each other.
First Kastriot Ramadani to note that Andy Pajaziti and Gezim Zakuti had entered the club, the same had acted as Dukagjij, who pulled the gun out of a bag carrying it, where Pajazit for a moment began to physically clash with defendant Nicolaj.
On the other hand, according to the Prosecutor's File, Kastriot Ramadani with a glass bottle strikes the defendant several times as defendant Andy Pajaziti, the last with firearms fired in the direction of Kastriot Ramadani. Kastriott Ramadani also retaliates with firearms, but he is not the only one, since Nikolay is also shooting at Pajazit.
Acts that the Prosecutor's Office claims have risked the lives of other persons who had suffered bodily injuries from firearms.
Other injuries were left by Andy Pajazit of Hissoni Gecaj, while the wounds of the firearm had failed to survive Kastriot Ramadani, who had even passed away at QKUK. Thirteen people, according to the Prosecutor, were hurt by broken glass glasses in an attempt to leave the scene.
