In the decision published on the Special Court's official page, it is stressed that the victim's wife has agreed to be part of further procedures to be held at The Hague.
“Supporting this interpretation is Article 22ė3) of the law, which predicts the victims have the right to notice, recognition and compensation. As noted by the judge of the preliminary procedure, recognition requires that the damage suffered by the victim be recognized. To ensure the effectiveness of this right, relatives of deceased victims or close-connected individuals can participate instead if specific parameters” are met, the decision further states.
The victim's “Avicta has handed over the death certificate V131/06 as well as the V131/06 marriage certificate and her husband, [I] REDAKUED].11 Every document has official nature indicators based on their letter, presentation and official stamps present in the documents. Therefore, the panel is satisfied with the authenticity and credibility of the submitted documentation. Consequently, the panel finds that the victims' lawyer's parachutes meet the necessary requirements described in paragraph 7 for V131/06's husband, [ Footnote] REDAKUED], to resume action on behalf of V131/06”, the decision said.
