Chief Parliamentary Glauk Konjufca has led to the Venice Commission The Bill on Change and Fulfilling of the Law for the Prosecutorial Council, reports Express.
For the bill the Government prosecuted in the Assembly a few days ago, Konjufca Konjufca has sought opinion from the Venice Commission.
Because the draft has undergone changes since the Venice Commission's assessment, Chairman Konjufca has demanded opinion on the bill as a whole, considering it crucial to achieving the goal of reforming the Kosovo Prosecutorial Council and addressing previously raised concerns and issues”, the Media Directorate's press communiqué and relations with the Assembly Public.
“As a member of the Venice Commission, Kosovo remains committed to respecting the fundamental principles of democracy, human rights and rule of law”, the communique says.
This Konjufca movement was welcomed by the European Union.
I welcome Glauk Konjufca's readiness to consult the Venice Commission for revised referenda in the KKP Law. Agreeance with European standards is the main priority in implementing reforms”, EU Office in Kosovo chief Thomas Szunyog wrote on Twitter.
The Constitutional Court in March had rejected the law on the Prosecutorial Council, which, according to the Government, would pave the way for deep reforms in the justice system. Under the indictment, the law was in conflict with provisions of the Constitution for the form of governance and power sharing, the competencies of the Parliament, the role of the Pulululli Lawyer, equality before the law and Article for the Prosecutorial Council.
The overturned law determined that six of the nine current prosecutors in the KKP would be suspended. Three, who would remain there by the end of the mandate, would be selected by a lot, as Minister Albulen Haxhiu said. To complete the composition of the KKP, elections would be organised at the level of all prosecutors, where each prosecutor can vote.
The highest instance of legislative and executive power in Kosovo has had serious remarks, especially at this point. According to the Constitutional Court, this would also have implications for democratic order and rule of law in the country.
The rational Constitution had mentioned the Venice Commission's opinion, saying that “the early conclusion of the mandates should always be linked to an identifiable violation or failure to perform the task of the relevant member and follow the basis, including the constitutional/legal procedure for the dismissal or end of the mandate under which” has been won because otherwise, “the suspension of constitutional institutions' mandates mandates could depend on the continuation of executive and/or legislature<3x>
The Constitutional Court estimated that “took into account the nature of the controversial Law provisions stated contrary to the Constitution and that the rest of the contrary Law would be difficult to implement after the declaration of the above provisions as invalid, the controversial Law, in the service of the principle of judicial security, should be declared invalid in its entire body”.
