What happens if Trump is arrested?

Former American President Donald Trump claims he will be arrested Tuesday on several counts of an investigation into a $130,000 payment to pornography star Stormy Daniels in 2016.

If arrested, then he will become the first former president in U.S. history to face criminal charges.

What can Trump blame for?

In 2016, the star of pornographic films, Stormy Daniel, has contacted several media, offering them the sale of materials from a relative she supposedly had with Trump in 2006.

Trump's team committed to this case and his lawyer, Michael Cohen, paid $130,000 for Daniels to shut up.

Something like that is illegal.

However, when Trump has compensated Cohen, the official registers are said to have paid under the excuse for legal commitments.

Prosecutors have said it proves Trump has forged business documents, and this constitutes a criminal offence in New York.

What if Trump gets arrested?

If he is accused, Trump lawyers have said the former president's arrest would be realised according to standard procedures.

It means he'll travel from his home to Mar-Lago in Florida to appear before the court in New York City, and submit to procedures, such as pointing fingers and shooting pictures of the accused.

Considering the historical nature of such an action, and security concerns, the way these developments can occur is unclear and may be subject to negotiations between the Prosecutor's Office and Trump's team.

When it is decided on the case and the judge is appointed, other details are easier manageable, like the timing of the trial and possible travel restrictions, or parole requests of the defendant.

The eventual penalty for wrongdoing could result in fines.

If Trump is convicted of serious wrongdoing, he could be sentenced to four years in prison, though some legal experts predict the fine is more likely, and that putting the former president behind bars is the least likely option.

Will there be protests?

Following his statement on social networks that he will be indicted on Tuesday, Trump has repeatedly called on his supporters for mass protests.

The language used highlights its harsh rhetoric before the attacks on the American Congress in 2021.

Hence, concerns about renewed violence have also increased.

Bragg is in close contact with the New York police and security authorities, according to a letter that has come from American media.

“We will not tolerate attempts to intimidate our office or threaten the rule of law sector in New York”, he wrote.

Yet, there is little information now that large protests can be organized, such as those on January 6, 2021 at the convention building.

Can Trump race for president?

The evental indictment, or even criminal punishment, would not stop Trump from running if he intends to continue.

Trump has given signs he doesn't intend to stop, no matter what happens.

In fact, there is no article in American law preventing a candidate from being convicted of a race crime or even the president's mandate even if he is in prison.

However, Trump's eventual arrest would complicate his presidential campaign.

Although this situation may spur some republican supporters to march, the arrest may clearly distract his campaign.

Such a development can also deepen divisions in the American political system.
