According to SPS's argument, Thaci's detention is reasonable in the current circumstances when the trial process against him will begin soon.
In this regard, the panel recalls that the reasonableness of continuing the detention of an accused should be assessed in the facts of each case and according to its features, which in this case include: (i) Mr. Thaci; (i) his knowledge of the charges and evidence against him, and the possibility of a prison sentence; (ii) the danger that Mr. Thaci would prevent the KS procedures; (iv) the risk of conducting, promoting or helping further crimes; (v) that restrictive measures for release are not enough to ease risks; (vi) the weight and complexity of charges against Mr. Thaci; and (vi) the fact that progress continues to be made towards the beginning of the trial.”, says the Prosecutor's Parliament.

The Court of Appeals College also reportedly has supported the implementation of different factors in this context.
The risks identified under Article 41H6 (b); (ii) the conclusion that some risks cannot be softened, and (ii) the possible punishment facing the accused after his sentence based on the weight of the charges. The panel concluded that these factors weigh in favour of continuing detention in the case in question and reminded that using these factors in determining the reasonableness of continuing detention is in line with the practice of human rights and international criminal courts”, it said in advance.

While referring to previous decisions by the Court of Appeals regarding Thaci's detention, the ZPS finds at the bottom that these aforementioned factors and additional factors make Thaci's detention reasonable, taking into account the date of the start of the trial is approaching.
