There's the DA's file: Donika Gervala allegedly hid some 2,000m2 land in Decani and Germany's business

The Constitutional Prosecutor in Pristina has filed charges against Foreign Affairs and Diaspora Minister Donika Grovall, over the charge of not reporting property correctly.

The “Justice Vow” has secured the full indictment, which turns out to have been compiled on January 31st 2023 by the prosecutor Astrit Gashi.

According to the indictment, Gervailla is charged that in the quality of the high public official with the legal obligation to declare property, in the form for property statements on March 22nd, 2021, he has not accurately presented the required data by law.

The Actakuz says that, the same on this form, has not declared any in-lines of her husband, Stefan Schwarz, even though he has declared the same as a husband.

On the other hand, it is said that Gervala has not declared the entire cadastral-land agricultural parcel, owned on its surface of 3964 m2 in ZK Dubovik-Decana, declaring only 2,000 m2.

Also, Gervalla allegedly did not declare any business “Alb Lingua UG” registered in Germany's Bonn on behalf of her, reports “Justice Vow”.

With these actions, Gervala is accused of committing criminal work “due to false reporting of property, income, gift, other material benefits or financial obligations, by Article 430 paragraph 1 of the Republic of Kosovo Penal Code.

The prosecution, through the indictment, has demanded that the same be found guilty of the burdened criminal acts, and has proposed to the court to make the seizure of undeclared value.

What did the Gervala Ministry say to the prosecutor?

Regarding this criminal case accused Gervalla-Schwarz in November 2022 has issued a statement to the prosecutor, where the same had stated that she had not been aware that in the form of property statements she should also declare her husband's income.

Because I thought that my husband's personal data, as German subjects, without any physical or legal connection with Kosovo, is protected in Kosovo even by German law, much more than my husband's monthly salary, there is no playable or real estate that would come into consideration to declare on that form”, Gervala had declared.

Gervala had confirmed that his first statement on the case of taking office on March 22, 2021.

I've included my husband's income of about 54 thousand euros annually. This has happened after I have been announced by the AKK that, according to them, wealth and foreign citizens should be declared. I'm not quite convinced that such a thing is true, but with all that, to avoid misunderstandings, I also included my husband in this statement.”, she said.

In the case of stating the same duty, however, she had stated that she was not interested in whether her husband's income should be declared.

While, in terms of land surfaces, Gervalla had declared that in the village of Dubovic in her possession there are three parcels, which are family heritage.

According to her, the first parcel is the site where the house is located, the second is marked as untapped agricultural land, and the third is mountainous land without exploitation.

At her family's home in Dubovic, she had said she lives a family of four members who are my father's cousins.

I'm based on consultation with the resident of the house, counting that no one better than him can make the evaluation. Property certificates I have never personally had in hand, but I know I've been on the phone years ago that such a certificate exists and was handed over to the residents of our home in Dubovik”, Gervala said.

As for the “Grvalla” Foundation, she had declared that the foundation in question since its establishment in 2006 has not circulated a single cent within Kosovo or outside.

This year's “criminal reporting, with fact-clearing and full clarity about my lack of motivation to hide my wealth, my income, or any kind of financial activity I consider motivated by political vengeance and an attempt to denigrate personality”, had declared Gervalla to the prosecutor.

By contrast, on June 20, 2023, the original examination of Donika Grovala had failed because the same was not a lawyer.

The Constitutional Prosecutor in Pristina, 29 May this year, has confirmed that he has filed an indictment against Gervala.

After the news of setting up the indictment became known, Minister Grovalla had said it was an attempt to bring mud on representatives of institutions.

On October 2nd 2021, “Justice Vow” had reported that Donika Grovalla, Deputy Prime Minister and Minister of Foreign Affairs and Diaspore (MPJD) did not declare all functions in local and international institutions.

Four months after this research, the Anti-Corruption Agency (AKK), now the Agency for Prevention of Corruption (APK), had announced it is still handling the case of Minister Gervalla.

According to this research, it proved that Gervala did not declare that she owns business in Germany, has not shown that she is the director of a foundation in Kosovo, nor has she declared the wealth of her husband and children.
