What should Kosovo do to issue international arrest warrants on Radojicic?

On Sunday and September 24th, several armed men have attacked the Kosovo Police in the village of Banjska in Zvecan. It was there that Sergeant Africa Bulnjak was killed, and one was injured. While some of the attackers were arrested, a large number of them managed to flee the mountains and crossed into the territory of Serbia, including Milan Radojiciqi, who is on the Black List of the US and the United Kingdom.
Radojici took responsibility for the terrorist attack in Banjska, where at least 3 of his friends were killed after a long shootout.

Today, Serbia's Interior Ministry has announced that he has been arrested and sent to the hold for 48 hours, meanwhile, Kosovo is expected to issue international orders against him. The procedure has been addressed by IKDA executive director Ehat Miftaraj.
He said the prosecutor of the case applies for international arrest warrants and submits that request to the competent court, which then takes him to the Ministry of Justice.
Miftaraj says the MD will then need to proceed to UNMIK for the warrant to be placed on Interpol database.
The moment the prosecutor of the case has a ruling on the launch of the investigation, in which persons allegedly suspected to have been part of the terrorist act in Banjska are known, the state prosecutor has the right to issue international warrants for all those persons who are known to be not on the territory of the Republic of Kosovo. The request for issuing the warrant is sent to the competent court, which after adopting it back to the Ministry of Justice, which then prosecutes it to UNMIK as the authority that makes or puts the warrants on Interpol database”, Miftaraj said.
He pointed to some of the criteria that must be met to issue an international warrant.
The “in the first place, under Kosovo's applicable law, are defined criteria that must be met to issue international warrants, including the name of the wanted person, photography, fingerprints and other documents proving the same is suspected of a criminal act. Depending on how effective the Court and the Ministry of Justice will be in this case, the same one can be declared in Interpol within days”, Miftaraj said.
He stated that this “security data” possess the security and justice institutions in Kosovo, as Radojkiqi has been sought even earlier by Kosovo institutions.
With the very fact that Radojicic is wanted earlier by Kosovo institutions and that there has been an international arrest in Interpol, this data is certainly capable of enabling security and justice institutions in Kosovo”, he said.
While attorney Skender Musa said that before the issue is issued, the national rowage should be issued.
There are several procedures, the Kosovo authorities' efforts must first be exhausted. When the national line is issued, and if it doesn't, then the international line comes in. It doesn't go directly on the international paper”, he said.
Musa voices sceptical whether Serbia will hand over Radojici on voluntary terms.
I don't think Serbia's own justice organs and president of the country voluntarily hand over Radojici without any international pressure. They'd like to try to play the part that they're the ones who made me live and hold a false trial, as has been the case with war crimes. ”
He cited a problem, which he said hinders Kosovo.
“We are a little overworked, because a part of the states don't know us and we don't have international co-operation with a part of the states, which is the competence of MDU”, he said.
Justice Minister Albulen Haxhiu has also been declared on the matter. She told EO that they were expected by the Court to apply and then act.
The Justice Ministry is obliged to address the tribunal's demands in other institutions. In this case, when it comes to international petition, we are expecting the Court to apply for international petition, and immediately without delay we will act in accordance with the competencies we have. There will be maximum efforts for all attackers to identify, because there has been a large armed group that has tried to extend its influence to other Serbs as well. Fortunately, local Serbs have not joined”, she has said.
The newspaper has asked the Ministry of Justice earlier if they have accepted the request from the tribunal, Haxhi Chief of Staff Genc Nimoni said it cannot provide specific answers because of privacy.
