From the KKP, they have expressed deep disagreement with the President's statements, saying there are “built on a level more political than constitutional and legal”, while its excuses for the non-Decipience of Isupfe, have named “the unfounded and extremely biased”, the Express report.
The KKP says such public statements constitute direct intervention in the work of the prosecutorial system, at the State Prosecutor's Institute, respectively.
For the President's statements that there have been pressures and threats, the Prosecutorial Council has invited President “that if there is evidence and evidence to send them to the competent bodies, so that they can be fully enlightened”.
“In this case, in terms of assessment of the procedure, the Prosecutor's Council stressed that it stands behind the election procedures of the chief state prosecutor, and that such statements -- for the sake of having identified all violations on the part of the KKP -- are in open opposition and, in that sense, the president of the Republic cannot even appoint any prosecutor without the Prosecutorial Council's proposal, but cannot refuse the Prosecutorial Council's proposal for the appointment of prosecutors. As stated further at this meeting, the only space where the president of the Republic, in terms of competence in paragraphs 5, 6 and 7 of Article 109 of the Constitution of the Republic of Kosovo, where he can act is that he can reject a prosecutorial council proposal if he/she does not meet formal conditions, but by no means reject it for substial reasons.
Moreover, according to the Constitution of the Republic of Kosovo, the competency of the country's president of decree is only related to the KPK's proposal, which unanimously proposed Mr. Blerim Isufaj, for the position of chief state prosecutor”, is said in response.
Otherwise, Osmani announced today that he has decided not to decree Blerim Isufaj for the country's Chief Prosecutor.
“Based on the spirit and letter of our Constitution, argued by the numerous judgments of the Constitutional Court, I consider that we cannot have constitutional functioning of institutions unless a process is carried out on respecting constitutional and legal procedures”, Osmani said.
It showed that the “process of selecting the chief prosecutor has been described as unfair, discriminated against, orchestrated, illegal by all observers of the process, both by local organisations and by many of the international partners”.
Its assessment, Osmani said it is “within its constitutional mandate” as president, and that it has “recorded all violations”, citing some of them.
Full response:
The Kosovo Prosecutorial Council (KPK) has held a closed meeting, in which it has discussed the situation created following the announcement of Kosovo President Mrs. Vjosa Osmani, for failing to arrest the new State Chief Prosecutor, Mr. Blerim Isufaj, expressing deep disagreement with her statements, built on a more political than constitutional and legal level, with highly groundless and extremely biased reasonings, which she presented today at a media conference.
The KKP has kept the public constantly informed about official communications and paperwork addressed to the President's Office, as well as earlier, about the process of selecting the chief state prosecutor, so it found that, the president, as guarantors of implementing the Constitution of the Republic of Kosovo, at today's press conference confirmed the systematic effort to extend political influence on the Kosovo Republic of Kosovo's prosecutorial system, with regard to this issue, presented the unstable reason for the non-recognition of the C-ordination of the chief state candidate, which is in opposition to constitutional and constitutional norms.
The Prosecutorial Council estimated that such public statements constitute direct intervention in the work of the prosecutorial system, respectively, at the State Prosecutor's Institute.
Regarding today's statements that there have been pressures and threats, we invite the country's president who, if there is evidence and evidence to send them to competent organs in order to be fully enlightened because the prosecutorial system is a special constitutional, independent and impartial institution that carries out its duty in accordance with the constitutional and legal mandate.
In this case, as far as the procedure is concerned, the Prosecutor's Council stressed that it stands behind the procedures of the chief state prosecutor's election and that such statements -- for the sake of identifying all violations on the part of the KKP -- are in open opposition and, in that sense, the president of the Republic cannot even appoint any prosecutor without the prosecutor's proposal of the Prosecutorial Council, but cannot refuse the Prosecutorial Council's nomination proposal for prosecutors.
Blerim Isufaj, for the position of chief state prosecutor.
At the end of this meeting, the KPK was told that it would soon hold a meeting to decide on the steps it will follow after the president's announcement of the chief state prosecutor's failure to comply.
