An indictment of a person for sexual rape during Kosovo war

The special prosecutor reports this is the next indictment for trial in absentia, in terms of a case of sexual rape during the war in Kosovo.
According to the indictment, the defendant with the initial M.J. As a member of Serbia's Ministry of Internal Affairs police, contrary to the rules of international humanitarian law, during a broad and systematic attack by Serb military, police and paramilitary forces, against the Albanian civilian population in Ferizaj municipality territory, given the existence of such an attack, with the use of violence and other inhuman acts, in co-ordination with other unidentified persons, thus far, has committed sexual violation against the female Albanian Nationality, which at the time of the rape was minor.
In this case, the victim suffered severe physical injuries and permanent psychiatric trauma.
With these M.J. defendant actions. has committed a criminal offence against the civilian population by Article 142 of Yugoslavia's Penal Code (which was in force at the time of the criminal act), currently incriminating as the crimes against humanity by Article 143 paragraph 1 under paragraph 1.7 of the Republic of Kosovo Penal Code”, the Special Prosecutor reports.
The Special Prosecutor has proposed to the competent court that the trial be held in absentia after all legal efforts were exhausted to locate the defendant.
