The Constitutional Court in Pristina has continued the detention of three terrorists for two months suspected of the September 24th terrorist attack in the village of Banjska in Zvecan, where police sergeant Africa Bunnjak was killed.
This ruling has appealed defendants V. T, B.S. and D.M.
However, the Kosovo Court of Appeals has rejected their complaints as groundless, while the Constitutional Court's decision in Pristina on 20,10.23 has confirmed.
With the Constitutional Court Act in Pristina, PPPS.N.44/2023, dated 20,10,2023 defendants V. T, B.S. and D.M. has continued the detention measure in two lengths of (2) months due to suspicion based that defendants V. T, B.S. and D. M, have committed criminal acts against the Constitutional Order and Security of the Republic of Kosovo by Article 126 of KPRK and the carrying out of terrorist works by Article 129. KPRK”, said in communiqué.
“S.n.2/03/2023, dated 30.10.23, has denied complaints of defendant V's defenders as groundless. T, B.S. and D. M, as the Constitutional Court's Act in Pristina Special Department, PPPS.nr.44/2023, has proven”.
In reasoning of the ruling Court of Appeals, the Court of Appeals has stressed that the court in the first instance has thus far argued that the subject's paperwork, respectively, from evidence collected so far, there is a doubt that the defendants have committed the criminal acts for which they are suspected and also from evidence collected so far, legal conditions have been met from Article 184 par.1 below par.1 and 1.2.1 points 1.2.2.2 and 1.2.3 KPRK that are the conditions for continuing the detention measure.
