Following approval of the request for protection of legitimacy against defendant J. K, the Supreme Court has changed the Constitutional Court's ruling in Gjakova, where the same was interrupted by the detention measure being released for freedom.
J.K. and H. K, the two defendants are suspected of irresponsible medical treatment, with what cases the 35-year-old patient died.
This has been made known by Leka Muqa, an information official at the Gjakova Foundation Court.
While for the H.K. defendant, the same has announced that after the deadline was passed under house arrest, there had been no further request from the Gjakova Constitutional Prosecutor for continuing the move or appointment of any other measure.
I inform you that with the approval of the defense request for the legality of defendant J. K., the Supreme Court of Kosovo, has changed the ruling of the Constitutional Court in Gjakova on 20,09.23, with which the defendants continued detention for two months and the decision of the Court of Appeals of Kosovo, of the 28.09.2023, which had rejected him as unconcealed on the grounds of the defendant's plea and had confirmed the first degree's conviction, so that the defendants, in the conviction of the 1710.2023 Supreme Court of Kosovo, are interrupted by the detention measure and immediately following the plea of this indictment, is a plea for your release of freedom in the court, Betek's response to the justice.
Also, Muqaj in his response said that, until now, at the Gjakova Foundation Court, no charges regarding the case had been handed over.
Otherwise, on August 22nd the Kosovo Police had arrested top defendants, after allegedly committing criminal work “irresponsible medical treatment”,
“Malevo 22.08.23-1300. In connection with the case, two suspected persons have been arrested a female and a Kosovo male, who allegedly carried out the above work on the Kosovo female victim, who has passed the life of”, the police report said.
In the case, Health Minister Arben Vitita had reacted, who said this tragic case marked a crucial moment for the prevention of impunity and irresponsability in licensing practices.
The Ministry of Health, on the other hand, has announced that the office where the deceased has been treated has acted illegally.
Even the Oda of Kosovo Stomatologists has reacted after the case in Malisheva, where a woman allegedly died as a result of irresponsible medical treatment. They pledged that after receiving reports from the Health Inspectorate, they would take appropriate measures against the dentist.
